Single Movie Download Could See Swedes Prosecuted

The Swedish Government wants to implement a change in the law which has the potential to make Sweden one of the toughest countries in the world to share files. Currently file-sharer identities can only be obtained following crimes worthy of a prison sentence, but if the authorities have their way the threshold will be lowered to include any offenses which could lead to a fine.

For more than a decade Swedish netizens have been placed at the forefront of mainstream file-sharing culture, mainly through their historic links to the thriving BBS and warez scene (not to mention bandwidth on tap), but more recently due to their association with The Pirate Bay and similar sites.

This status did not go unnoticed by the world’s leading entertainment companies. Their response for the past several years has been to lobby, threaten and otherwise coerce Sweden’s government into taking tougher action against file-sharing sites and file-sharers themselves, and not without result.

In addition to raiding The Pirate Bay and sentencing its founders to jail, Swedish authorities have spent the last few years going after file-sharers who share many thousands of files at once. In theory these multiple infringements can result in a prison sentence, so on this basis the police are allowed to obtain file-sharers’ identities from ISPs.

However, if the Swedish government has its way, in future downloading a single movie could be enough for the authorities and copyright holders to come knocking.

The issue surrounds a proposed change in the law which would allow police and prosecutors to obtain the identity of individual, even though their alleged offense is only deemed serious enough to warrant a fine.

Although the proposed changes to Sweden’s Electronic Communications Act (LEK) are ostensibly being proposed to target fine-punishable offenses such as child grooming or even bullying, their scope would encompass petty file-sharing too.

“I would no longer need to make a preliminary assessment of the criminality of the offense I am investigating. If I have an IP address, can I request information about who is the subscriber, regardless of the seriousness of the offense,” says Henrik Rasmussen, a prosecutor specializing in copyright infringement.

“Of course, a violation of copyright law has been committed even if you just download a movie from a source that is not lawful. The risk then of course is that even those people will be contacted by the police, be interrogated, prosecuted and convicted,” Rasmusson adds.

While the proposed legislative change would not give police the power to search the homes of suspected file-sharers for these minor offenses, Rasmusson says there are other ways to get the evidence needed to prosecute.

“We can also call people in for questioning and it has happened several times before that when people have to face certain facts they admit the offense. We might use that on a larger scale,” Rasmusson adds.

Founder of the first Pirate Party, Rick Falkvinge, told TorrentFreak that the proposals demonstrate the Swedish government’s continued “lapdoggery” towards the United States.

“This was point nine in a cable from the US Embassy regarding a checklist the US had given to the Swedish government to avoid trade sanctions from the United States.

“It is also remarkable how far beyond ’1984′-level surveillance this takes us when combined with the Data Retention Directive. In that dystopic novel, if the government didn’t see you doing something bad at the moment you did it, you were safe. With this law and Data Retention, the government gets the ability to rewind and play back if they missed your dissenting actions the first time.

“Our civil liberties are crumbling, and we’re venturing into very dangerous territory,” Falkvinge concludes.

Patrik Hiselius, a lawyer at ISP Telia Sonera, told SvD that it is important to find a balance between law enforcement, privacy and cost, and that combating file-sharing through legislation is not the answer.

“Put down the attempts to constantly find repressive means to the problem,” Hiselius advises, adding: “The way to curb file sharing is to provide better legal alternatives.”

      Sweden has always been a chicken of a country without getting into historical details. I doubt it can withstand this type of pressure from the USA. I live in Sweden at the moment but this makes me glad that I’ll be out of here shortly.

      However, most citizens would be certain to be against this law, so unless they will completely circumvent democracy, this will lead to mass demonstrations and hacking of previously unheard of levels.

        Do it. With the way ACTA is failing in the EU, I bet it wouldn’t be hard to block the US (and I’m in the US). The US is dependent on foriegn trade to survive and many need a wake up call to pay attention to this stuff.
        I think it’s insane to pay for a global unwinnable endless “whack-a-mole” war at taxpayer expense.
        From the sounds of this, it’s only the beginning. You can be sure even if Sweden caves on this – more restrictions will be coming. Someone wants to own the air you breathe and the water you drink. Count on it.

          Well, yes, they are subject to swedish law. afaik however, a VPN service is for good and valid reason not supposed to retain traffic data which means there is none to hand over.

          Check your VPN’s policy on what logs, if any, that they keep.

      In this particular case, I think it means the Swedes have decided to lap up the bullshit the USA trade ministers spout in defence of their paymasters (Hollywood) and have decided they like to take it doggy style from that which they see as some ‘higher power’ (USA in general).

      Maybe they’re a bit scared of being ‘smart bombed’ as well but for the life of me, I am seriously beginning to wonder if anyone ‘smart’ exists in Sweden

        I don’t know why Sweden takes such threats seriously. The US can’t enact sanctions against Sweden. Any politician who tried it would be ending his career. It would be like sanctions against Canada.

        Any move like that would take at least a years worth of propaganda and spin on Fox News to alter public perception enough first.

        In Sweden we’ve taken that so far the established political parties consist of a mass of political dogmatists too incompetent to survive on any job market, a very few ruthless opportunists herding the rest…and an ever-shrinking cluster of highly intelligent, rapidly disillusioned people who found out the hard way how the party treats anyone who dares dissent.

        Although this opens the way for new, younger parties consisting of people for whom the words “citizen’s rights” isn’t just a blanket cliché meant to slightly perfume the latest pile of crap to be shoved ungently down the citizenry’s throat, it also means that enormous harm is done to the existing body of laws and general citizen’s rights before crunch time comes.

        Right now we are truly deeply in it. We have a justice minister (Beatrice Ask) who makes GWB look like Stephen Hawking in the brains department and whose only demonstrated major talent in her long political career of repeatedly proven incompetence appears to have been giving an emphatic “Yes” to her boss.

      A “lapdog” is a dog that is both small enough to lie in a person’s lap, and is docile enough to be content to just lie there.

      When used to refer to people, it means a submissive person who more of less worships someone else and is content to do whatever they say.

        Another set of victims of US-backed oppression. Don’t be fooled, over 1/2 of the prisoners who died in that fire hadn’t been convicted of any crime, and were still awaiting a court date. Also the guards (who are the police – there is no distinction in Honduras) ensured that the prisoners were locked in their cells, where they were burned alive.         Xvid is nothing but a codec for H264 video. These DVD rips were re-encoded which is the real crime against quality. It is possible to create quality H264 content from original, raw content however.

          It’s rare enough to find a DVD player that plays Xvid/AVI files. None of them will play H264/MKV files. Yes some (all?) Blu-Ray players will play them, but Blu-Ray adoption hasn’t exactly been sky-rocketing. Do portable Blu-Ray players even exist yet?

          Also, while an H264 encoded video has the potential to be smaller than Xvid at the same resolution, that’s rarely the case. In virtually every instance I’ve seen, the MKV version is just as large, if not larger than the AVI version. Also, HD files can be huge. Finally, there are a ton for tools for working with AVI files, but the same can’t be said for MKV.

          I can’t remember what exactly defines H.264, though a look on XviD may suggest that it is H.26″3″.

          If we’re talking H.264, then x264 is all you need. In fact, that’s the the only video codec you should encode with, because for all I know, it’s the best on the market.

          Also, MKV/MP4/AVI are only containers, MKV being the superior one in this case, and AVI the worst. Not that they aren’t all fully operational and functional though.

      Something like that actually happened. One of IFPI’s (europe-version of the RIAA) big leads on illegal filesharing in sweden actually turned out to trace directly back to the Swedish Film Institute (one of the primary stakeholders of the Ifpi in sweden).

      The report from the concluded investigation stated that although the traced ip adress belonged to the hardened router employed by the institute, there was no shortage of suspects outside the university who could in theory have made use of that adress by either illegal or perfectly legitimate methods.

      What this summary is very careful to avoid is the rather unavoidable conclusion regarding the reliability of ip tracing – and the obvious suspicion that someone who didn’t like the Swedish Film institute or Ifpi much saw to it that said organization had to waste a great deal of time and money to prove they were actually legally compliant with the push of a few buttons.

      Yes, whoever tries to push a law such as this through will have very much cause to regret it once people such as Anonymous/LulzSec/fill-in-favourite-net-troll et al. get started.

    it’s also such a shame that any government is so scared of another country and, specifically, an industry in that other country, or perhaps getting such huge paybacks, that it then shows such disregard for it’s own citizens, preferring to outlaw just about every single one of them instead. what a despicable attitude to have!

        Proportionality in law usually demands very stringent criteria on when it’s considered reasonable to perform a violation of a citizen’s private data.

        The connection between a user ip and a physical adress will by default also supply all traffic data, including everything from bank transactions to highly personal details such as connections to politics, health care and personal opinion.

        In order to consider such a violation of personal privacy justifiable you need to have a suspected crime which is considered serious to some degree.

        These criteria are NOT fulfilled if the matter concerns a citizen who may have jaywalked or made a few extra copies of a media file.

    Dear swedish ISPs, you have the key to resolve the problem: just cut all internet connections in Sweden half a day and let see how laws can be modified…
    This is really the lamest proposition I ever-EVER read, and seems to be in contradiction to european laws as well. And since Sweden is member of the EU, i believe the first convicted should take his case up to the european supreme court and see what happens here..

    People of Sweden should ALL download movies at same time and send their IPs to police to be prosecuted and arrested.
    Would like to see how the government will work with a large number of people to prosecute and arrest at same time overloading their jail system and costing massive amounts of money to do that.

        North America = 528.7 million (USA = 313 million, Canada = 34.8 million)

        So in conclusion the European Union already has a population 60% larger than the United States but the EU will expand further in time.

Those very same people however, do tend to consume an awful lot of their “crap” so why should those people be entertained for free ? …..by anyone, unless those people want to give their crap away for free, which clearly many producers don’t want to.

        And as usual you conveniently gloss over the topic at hand which in this case is the fact the manufacture of a single copy (LONG since covered by fair use law) has in essence become a crime in practice punished and investigated more stringently than what you usually find under “Assault and battery” headings.

        Not to mention that the legislation, no matter how far they stretch this, is useless against any filesharer who takes the most basic of precautions.

        Absolute worst case scenario, the internet filesharing community will be able to work unhindered in ad-hoc generated darknets established client-side while the legislation starts choking up fully legal social networks as a side effect.

        In a morbid way I welcome this as it will make the average John doe sit up and take notice that “copyright law” in extension means he can no longer post comments on Facebook. Once you threaten to take the “bread and games” away from the citizenry at large, you find a reaction akin to that which sank SOPA.

        Just that this time the damn is far larger. Once it bursts there is good hope that raging public opinion will just sink copyright law altogether without distinction.
        I used to consider that a bad scenario, but it’s becoming clear that IP laws in general will in human society always cause far more harm than good.
