Anti-Piracy Outfit Unplugs Warez Topsite ‘Swan’

Dutch anti-piracy outfit BREIN managed to pull one of the largest warez scene topsites offline yesterday. The servers of Swan, formerly known as ATS, were unplugged by their hosting provider WorldStream. The provider acted based on evidence provided by BREIN, and also handed over the servers to this private outfit. The police were not involved in the takedown, but instead it was the result of information allegedly provided to BREIN by a rogue member.

swanThe top of the so-called piracy pyramid lost a stone once again yesterday, as BREIN publicized that the Swan topsite had been pulled offline. According to the Dutch anti-piracy outfit, the topsite – formerly known as ATS – operated from 12 servers carrying a massive 220 terabytes of data.

The site had connections to a variety of scene groups and allegedly sold access to several well-known private BitTorrent trackers. Although the unplugging will be seen as an inconvenience and might delay some releases, none of the persons connected to the site appear to be facing legal action.

BREIN generally informs hosting providers of its suspicion that ‘illegal activity’ is taking place on their infrastructure and without the authorities getting involved the hosting provider then decides whether or not to take action. According to this scenario it is not impossible that Swan could reappear in a different location, as we’ve seen happening dozens of times after BREIN pulled torrent sites offline. But Scene groups and networks are complex creatures and take more time to reconstruct.

However, BREIN’s head Tim Kuik stated in a comment that his outfit is now in possession of the Swan servers. This is interesting to say the least, because BREIN has no authority to seize any equipment on its own, and the hosting provider can’t just hand over private customer data without a warrant.

In a comment Swan’s hosting provider Worldstream avoided these peculiarities and simply stated that they were happy to cooperate with BREIN.

“We can not accept such activities in our network,” the WorldStream owners explained. “BREIN is known as a reliable partner and provided very clear evidence to demonstrate that unauthorized files were made available on the servers. For us it was therefore quickly decided to cooperate in this action.”

The owner of Swan, who operates under the nickname MrTB, has also responded with a response to the events. With the exclamation “F*** me i’m famous!” MrTB claims that the ‘bust’ is the result of the actions of a rogue member. In addition he claims that BREIN misrepresented the facts since Swan only operated 8 servers holding 175 terabytes of data.

“I’m waiting for BREIN to offer me a job. I’ll be a one man wrecking crew: TaH, TDA, KoP, AUS, TEL, DC, FUK, TITS, PANDORA, NOT, GUK, 100SE plus the other 30 sites I was on,” he added.

“Peace out, and fuck you all!”

The last statement seems to indicate that Swan is not planning to make a return any time soon. This makes the BREIN action, albeit trivial, very effective. BREIN’s head Tim Kuik was asked for a comment regarding the ‘seizure’ of the servers but has yet to respond.

Update: Tim Kuik told TorrentFreak the following in response to the seizure of the servers.

“BREIN exerts the rights and civil enforcement remedies of copyright holders. That includes seizure of servers used for infringements. These can be claimed as property of the right holders. If the owner wants them back, he needs to identify himself, which of course means that he can be held liable as well, if we don’t locate him first. We have ample evidence of the unlawful activities carried out with the servers in question. This evidence convinced the hosting provider to cooperate. Conducting unlawful activities also is in contravention of hosting providers’ terms of use.”

    About them handing over the hardware itself – I guess it all depends on the contract they’ve signed, if the hosting company are allowed to access their data if they are in doubt that they are doing something illegal, but I somehow doubt that they are allowed to hand over personal data to a 3rd party without a court order…

    MrTB is fine and dandy chilling in Costa Rica, If he is on

    if these guys are stupid enough to think its a good idea
    to go back on a site with such an insecure op then more
    full them.

    It is quite likely that BREIN has just ruined any legal case they might have.

    If they got the servers instead of the police, any evidence within them is now legally contaminated and cannot be used as proof.

    And even if they find the server admin’s name, he now has had plenty of time to get rid of any other evidence (which is probably why he will not return – at least not with the same nickname).

    @cheapstyle, do you know how much power it would take to encrypt (and decrypt!) 220TB of data in real time on an FTP server? Also BREIN probably just bought their way in so even if it would’ve been encrypted they would have had a key (oh and yeah, they say they got the info from a ‘rogue member’ but obviously that’s bullshit).

    Timmeh strikes again. Unfortunate for BREIN this action will have no long-term effects. The members, and scene groups affiliated with this topsite will find a new home which will grow as large as ‘the swan’, or perhaps even larger. I really hope that ‘Mr. Kuk’ will come to see that his actions will have merely no effect, and if any, only pro-piracy consequences.

    And hey — humanity is based upon sharing, so what does this make of Tim?

    Though I am not certain of how much access is given to people who rent servers, but seemingly Truecrypting the entire volume would essentially, once the server was unplugged, essentially remove all the data from being accessed (unless they have the password, which would be impossible). The SCENE needs to die anyways, it’s like the BBS days basically.

    @i7x Its entirely possible to encrypt any amount of data you want, whether its 5gb or 220TB. Its all about the amount of cpu and ram you have to achive it. given this site was so large it wouldnt surprise me that the servers we very beefy in the means of cpu and ram specs. 95,000 euros is a lot of money and harddrives are cheap. I can only imagine how much ram these machines had in them. Also one thing you need to remember is, not one server is encrypting and decrpyting all 220tb, there were multiple servers.

    Our group is holding a little under 300TB and SWAN was only a seedbox group if nothing else. Most their torrents were retrieved via other private sites.

    OFC they will, that’s the point without them BREIN will close doors, you surely don’t want BREIN employees to lose their job with all the crysis going and so on… so this action has indeed long-term effects, it keeps all BREIN employers with job for a loooonnngg time as they well know when you bring down 1 site 100 will surface.

BREIN sure does like to “hype” them headlines up for the public and 90% of the rest of the pirate world that has no clue what a true top site is. and to clear it up swan was not 12 servers amounting to 220+ thats bold face lie.. try 8 and 175tb which the real people know thats just a drop of water in a bucket that you call “scene”.. swan being taking down will not affect anything so sorry BREIN go spend 10′s of thousands of dollars somewhere else and see what you come up with next time

    Is it possible on the basis of the admittance of the this Kuik person of being a criminal to give him up to the police referring to articles in the media ? (i know some people are protected to do illegal things, enough programs on TV about bankers, CEO’s and others with money never to carry the consequences of their actions)

    On the basis of the following:
    1. Having a suspicion that Brein now has stolen servers.
    2. Suspicion that Kuik has knowingly purchased or received and asked for illegal software/media (brein DOESN’T represent ALL right owners).

    I think they want to have those servers because they can copy the software for themselves before any (il)legal action is taken.

    BTW:
    Any such site should have some software, hardware security or inactive virus running on it which actives when seized to examine breins networks and send data over the internet over a prepared VPN.

    Really time for a dump of the BREIN network on wikileaks or torrent.

    What you’re going to do is give all the hardware back to WorldStream, when the owner’s lease is up WorldStream is goign to reclaim it and wipe the drives and partitions.

    There is no legal motive you have, because the drives were probly encrypted lol. It really sounds like you cant prove anything. So you disrupted a site, who cares life goes on. Now the owners will probly just branch off and start 10 new private torrent trackers, or start from the ground up again, and 50,000 -to- 100,000 people will end up reading about it, and be like mabye I should to, nothing happened to them.

    All you are really doing is throwing a wrench into a situation which is already inevitable. Lets stop progressing technology…. Oh wait, you cant.

    We will all be nice pirates and just go back 20 years and hand out vhs / betamax / 8 tracks to each other, then you can stop caring. Oh wait it’s the future, no ones going to do that.

    If anything Brein should be audited to see what really goes on behind their closed doors. Try to steal some more physical hardware, over virtual goods, like thats more important. You’re the real criminals here.

      This has nothing to do with torrents/trackers/torrent sites etc.

    You all appear to miss a very important issue here.
    Irregardless of what SWAN was doing you have a third PRIVATE PARTY _ NOT LAW ENFORCEMENT WITH A WARRANT – BREIN and Worldstream taking possession of another persons private property and giving it WORLDSTREAM to another private party BREIN without the owners SWAN permission.
    In any country I know of even in Holland THAT IS THEFT…. Since this so called “evidence” was obtained by BRIEN Illegally it would be in admissible in court – so there would be no case against SWAN civilly or criminally..
