Final Europarl Committee Rejects ACTA: Internet-Lobbyists, 5-0.

Today, the final and ultimately responsible committee in the European Parliament gave its recommendation on ACTA. Its opinion was clear: Reject ACTA. This brings five recommendations to the European Parliament to reject and kill ACTA once and for all.

actaA lot of prestige had been building up toward today’s vote in the International Trade committee (INTA), which was about to give its recommendation to the European Parliament on the ACTA treaty.

Six months ago, it looked like a no-brainer. Then, protests on the streets in Poland appeared, spreading through Europe like wildfire. The Polish government promised to put ratification of ACTA on hold, pending the outcome of the European Parliament. Shortly thereafter, so did pretty much everybody else.

So, all eyes on the European Parliament.

I have written before on why ACTA lives or dies with the acceptance of Europe: if two of the world’s three largest economies do not accept a trade treaty, it does not exist. China (#3) is not a party to ACTA, and it is being pushed by the United States (#2). If the European Union rejects it, the treaty is without practical effect.

So, again, all eyes on the European Parliament.

For an acceptance or rejection in the European Parliament, one committee becomes primarily responsible for every issue, recommending a course of action to their colleagues. For the many issues handled every day, this is usually a very helpful process – getting input from the people most knowledgeable on the topic. For complex topics, another committee can sometimes join in, sending their own recommendation to the responsible committee in turn.

For ACTA, there have been four such advisory committees in addition to the responsible main committee. Those four were Industry, Civil Liberties, Development, and Legal Affairs. They voted on May 31 and June 4, and all voted to recommend a rejection. This was encouraging for the net activists, very encouraging, but didn’t really say anything about the vote in International Trade – the main committee – for such a high-profile issue.

There has been no shortage of stunts pulled that were, at best, questionable. Yesterday at 18:00, the person responsible for ACTA in the European Commission (roughly the executive branch of Europe), Karel de Gucht, held a firebrand speech to the committee, telling them how to vote. He added that if Parliament votes the wrong way, he’ll just re-submit ACTA to the next parliament (!). He was later rightfully scolded by some Members of the European Parliament (MEPs) for showing an unacceptable level of disrespect for the separation of powers and for the democratic institution of Parliament.

So this morning, the INTA committee gathered for its vote. Some industry group had managed to put up a poster across the entire door, urging them to vote for adoption. This breaks a very long set of very bureaucratic rules and raised quite a few eyebrows. The room was filled to and over capacity – TV cameras were lining the walls, and people were standing in the back and along the sides, all seats being taken in the quite large room. INTA had 32 items on its agenda, starting at 10:00, and ACTA was last.

When an issue is adopted or rejected in committee, the committee starts out from a draft report suggesting a stance it should take, and then, any MEP on the committee can suggest a change – an amendment – to the draft. The draft report in INTA said that the committee recommends parliament to reject ACTA (“withhold its consent”). Some MEPs wanted these particular words to be replaced by others, so there were some amendments on the table. The two first amendments said the exact same thing – replace the words “reject ACTA” with “adopt ACTA” – and the third replaced “reject ACTA” with “postpone a decision until the European Court of Justice has said whether ACTA is legal or not.”

The party group lines were quite defined. The positions had been established, the prestige had been bet, the trenches had been dug. Those in favor of ACTA were the EPP and the ECR party groups, comprising almost exactly half of Parliament, and those against were the rest.

INTA started out with 29 MEPs present, and everybody kept counting who was present to try to figure out which side had the majority. Early counts said that the for and against sides had 14 votes each, so there was frantic activity figuring out where the 29th vote went.

Then, mid-session, an INTA MEP with voting rights showed up, bumping the total vote count to 30. Lather, rinse and repeat all the frantic guesses about majorities for ACTA.

Fifteen minutes later, repeat the same thing happening all over again as the 31st MEP appeared in committee.

At 11:30, the INTA committee finally got to the thirty-second item on today’s agenda, ACTA. The first thing that happened was that the first two amendments, those wanting to adopt ACTA, were withdrawn.

This led us to the situation where there was not even a proposal on the table to adopt ACTA. It was “say no now”, or “decide later”. So ironically, the trade group who was breaking half of the rules in the book by putting the “adopt ACTA” poster on the outside of the committee door couldn’t even theoretically have their will.

Moment of truth. Amendment three, changing “reject” to “postpone”. The vote was called, the vote was closed, and the numbers came up on screen. 13 votes in favor of the amendment, 19 votes against it, no abstains. WE WON! WE WON!

…but wait…?

19 plus 13 is … thirty-two. There are 31 MEPs. There was one vote too many. The vote was repeated, but at this time, it was practically over: one vote less from either side would not change the outcome. The amendment would be rejected, and the draft report would be adopted, recommending the European Parliament to reject ACTA.

The new vote said 19-12. The amendment was defeated by 19-12, and the draft report recommending a rejection of ACTA was adopted by the same numbers.

Thunderous applause interrupted the session. WE WON!

So what does this mean? The ironic thing is that it doesn’t really mean much in terms of the adoption or rejection process. ACTA is such a high-profile issue that people are already decided, quite regardless of the committee recommendation. But it does give you an indication of how the majorities lie — and what the vote in plenary in about 10 days will look like.

In the press conference after the INTA session, the sentiment in the room was one of a post-mortem. “Exactly where did this ACTA drive the crazy train off the nearest cliff?” Even though the ultimate vote in the European Parliament plenary still remains, the vote some time July 2-5, the sentiment was clear: it’s over. (Hint: it’s actually not. Not at all.)

Everybody in the press conference reiterated at today’s vote would not have had this outcome without energetic and persistent activity from citizens, urging MEPs to oppose ACTA. Yes, that’s you: you should pat yourself on the shoulder here.

In the press conference, we also learn that the reason for the large majority in INTA against ACTA was due to Polish MEPs not following the party lines, but referring to their home constituencies and saying they couldn’t do anything but reject. This changed the majority from harrowingly even between adoption and rejection, to having a safe margin on the side of rejection. It is a reasonable assumption that this phenomenon will carry over to the parliament at large.

    Whats the biggest issue with ACTA anyway?
    Here in Canada it got passed awhile ago, but I havn’t heard anything about it since.

    I guess they could have been holding out the full force of this agreement hoping it would get passed in Europe, I just hope other countries that have passed it end up rejecting it (is that possible?)

    But in the end if push comes to shove, I’ve always wanted to go back too live in Europe. Lately Canada(Harper) has been bending over completely for Obama.

        Actually, I have to point this out again: The way that ACTA is written, unless ALL parties sign it, NONE can. It’s like the law burst into flames if one country refuses to sign it.

    well done to all who fought against this bill and who, i am sure, will continue to do so against those other similar bills, eg TPP. however, i hope there is some sort of action taken against those that put up the banner, whoever voted when not allowed to (the reason for doing so being obvious!) and against Karel de Gucht for the disrespect and arrogance he showed to the committee. to say he will re-introduce the bill again shows even more contempt and he deserves to be chastised further. he deserves to be sacked and banned! going on his conduct, he must have received some serious ‘encouragement’ to carry on in the manner that he did. i hope his affairs are thoroughly investigated

    Internet-Lobbyists, 5-0.  And yet all it takes is one win by the Lobbyists in a few weeks to completely undo those 5 wins as well as set the internet back by decades. 

    Why does politics always feel like a game of ping-pong where one side has to reach 11 points to win, but the other side is declared the winner after only scoring 1 point?  Not to mention half the time the ref will use a paddle to help the “1 point” player recover from shots that would have gotten by him.

    As to the number of votes in INTA: how is it possible that votes are counted incorrectly?? How unprofessional is this? I can’t believe it is an actual error, since it happened before in other committees: what’s behind this?

      Probably the same thing that happened during the OOXML scandal that Microsoft pulled a few years back.  Toss a few bags of money into the right pockets, and all sense of rationality and/or respect for regulations and rule of law goes down the drain.

    Nicely written article.  While this may be the end of a battle, but you’re right, it’s not over.  There are still going to be plenty of attempts to control the internet.  It seems clear what people want, but unless people keep a close eye on politicians, these things will keep coming up.

    Good news indeed. ACTA will soon die.

    We do have many to thank bringing us this far. The most visible were the 200,000+ people who marched in dozens of cities all over Europe. These were not some trade union with pre-printed signs made in bulk but average Internet users so concerned they pulled up bamboo canes from their garden to make their own protest signs.

    Those in Poland do need a special mention when before these first European protests it was hard to believe we could take ACTA down. SOPA/PIPA showed we had the numbers but Poland proved we could leave our computers and mobilize on the streets.

    It is also worth noting that many of these MEPs and their assistants have been assaulted by younger members of their own family who were showing concern about ACTA and asking questions.

    ACTA may soon make one battle won but we are in very long War. We can win.

          It’s just that the elected officials aren’t even listening to them anymore, but only the people who give them money. Only solution, as I have said before: GET RID OF LOBBYING!
          Make giving any money or gifts or even talking to public officials by corporations/organizations unless it is done in a RECORDED AND TELEVISED manner illegal.

    I watched a videocast of a discussion. after the result…between 4 “contestants”…2 for/2 against…The main point that came out of it..to me anyway..was the claim by pro ACTA that the bill would not in fact change anything !!!

    He was unable to explain why, in that case, the bill had been proposed .

    still dont know whether those that voted against ACTA adoption did so because they didn’t want the law, wanted to maintain EU rights for citizens or were just worried about losing their jobs when the list of who did what comes out.

    had the very first one a while ago gone in favour of adopting it, i wonder how many more votes would have been taken? i can hear the entertainment industries now. no more votes needed, one is enough. strange how things that those industries dont like have to have multiple results the same.

    Karel Lodewijk Georgette Emmerence De Gucht (born 27 January 1954) is a Belgian politician (source wiki)

    belgian voters time to get this one recalled and removed from office, which would force MEPs to remember who EXACTLY put them in office and can remove them from office, basicly what he’s saying here is “I dont care what my bosses (the voting public of Belgian) say, if you don’t vote yes like the I’ve been bribed(lobbied with gifts from American content producers) and that he would still push for it to be passed in the next EU parliament despite Europe wide opposition to it, against the wishes of European voters in general and Belgian voters specifically.
    Time to remind MEPs and politicians in general exactly who controls things (Hint it’s NOT corrupt corporate America)and that we WILL NOT have our wishes ignored nor our freedoms removed or watered down.

      De Gucht is not a belgian politician. He’s a Commissioner. Commissioners are appointed by the parliament after being suggested by their respective governments, and history has proved they have one thing in common: they failed as politicians in their home countries. :-)
      Therefore I’m sorry to disappoint you, but there’s nothing Belgians can do about De Gucht. They didn’t elect him where he is, and they don’t have a say on who replaces him when the next Commission comes along.

    also maybe time to start ringing up his office and emailing him  asking him how he can support ACTA, why he thinks he can get it resubmitted and what makes him think he’s going to get the chance to resubmit ACTA again at the next parliament?
    Given it’s VERY apparent he’s been very heavily “lobbied” might also be time to push for a bribery and corruption investigation in Belgian if not within European parliament itself, and force out into public exactly what he’s been offered by lobbyists in exchange for his “work” on behalf of their bosses

       I agree wholeheartedly with the general thrust of your well-put argument Guess, but I also feel compelled to post this important clarification to your 2 posts (but please don’t worry or take offence, as it’s a VERY common error made by millions of European citizens and those outwith the EU too ffs!!)

      This right-wing pro-ACTA undemocratic asswipe called Karel de Gucht is, like the vast majority if not ALL of his other 26 Commissioner colleagues, NOT elected and he, like them all, are NOT answerable to the electorate at large.

      Do I detect shock & horror at this abominable revelation?  Not to worry, coz here’s what I’m on about.

      Asswipe de Gucht is NOT an elected MEP (ie  not a Member of the European Parliament).  He ‘serves’ in the European Commission (not the Parliament) as one of 27 unelected Commissioners.  Please see wikimedia for better info on this shit http://readerfeedback.labs.wikimedia.org/wiki/European_Commission

      In short, the EC (ie the European Commission) is a well-known democratic deficit that’s been built-in to the set-up of the European Union, but it’s powers are way too much given they’re not answerable to the voting public.

      That’s why they can throw undemocratic shit in our face like, “we’ll keep bringing ACTA back to the Parliament until you vote for it”.  It’s just so wrong, and it needs to be abolished and replaced with a 2nd Chamber of ELECTED politicians rather than being asswipes open to bribes by big business as they currently are!!

    I sent an email off to them and have been kept updated by email over the last week, If anything it is worth sending an email or emails just to keep updated.

     Now please torrentfreak, keep us updated for the next vote and where to email, also for showing our distates for TPP

    I don’t know where i got the email addresses to send the last email to the members but it was really easy , copy past, type a couple of nice words and voila you are part of history and your voice has been heard.

    As long as it is made easy enough to copy /paste the email addresses and a basic outline of the complaint or suggestion, more and more people will do it, it is when you have to scour the internet for all the addresses and type them all in one by one that people don’t want to go to the bother of doing it. I am satisfied i did my part as much as i could, i just wish i could have been out on the street but i live in a small village in the British countryside so emailing was all i could do.

    Those pushing acta show no respect for democracy or people or the democrstical process.
    Pushing those nefarious laws in the most ridiculous ways, and it is like that almost everywhere these days.
    So sad that we end giving this kind of people the power to choose for us and they betray us for the corporations paying them to gag society.
    The movment to oppose acta has been amazing an it is a sign of hope. There are still many evil laws being passed eberywhere but it seems like the interney is giving people th tool they needed to organize themselves democratically to chang thing and stop the lehal abuse of these corporate bought politicians.

    If passed into law ACTA will destroy the internet and severely limit our freedom to share information in the most undemocratic manner as it addresses much, much more than counterfeiting.  Please do NOT allow this to happen and I beg you PLEASE to vote against the adoption of ACTA.  We do NOT need it, and we do NOT want it.

    Nice account of what happened yesterday. You forgot to mention that during the examination of the points preceding ACTA discussion, there were 4 instances when EPP members (and only them. Coincidence?) voted more than once per MEP, forcing a new vote and thus delaying the inevitable. I think the EPP stunts (in this committee, in the LIBE committee where they asked for the agenda to be changed at the last minute, and possibly others which I failed to follow) deserve an article on their own, although probably not in TorrentFreak.

    Good notice, but be aware about the EU-Colombia-Peru FTA that will be ratified this Tuesday (one week before final ACTA votation). Some of their articles like the Article 254 that i noticed before are serious threats against privacy.
