Government Spies Illegally Bugged Kim Dotcom, Prime Minister Admits

New Zealand Prime Minister John Key announced today that he has ordered an inquiry by the Inspector-General of Intelligence and Security into the conduct of government spies leading up to the arrests of Kim Dotcom and his co-defendants. The GCSB is the Kiwi equivalent of the CIA and is forbidden by law to conduct surveillance on New Zealand citizens or permanent residents in the country. Nevertheless, the bureau helped the U.S. by spying on Kim Dotcom, Bram van der Kolk, and their families.

For some months now, Megaupload founder Kim Dotcom has been painting his fight with the U.S. authorities as quite literally a mega-battle, one that goes to the highest levels in the United States government thanks to the involvement of Hollywood’s elite.

Some of the claims about events stateside have been nothing short of sensational, but today confirmation of a new and quite extraordinary scandal threatens to further weaken the case against the Megaupload defendants.

This morning Prime Minister John Key announced he has requested an inquiry by the Inspector-General of Intelligence and Security after the Government Communications Security Bureau illegally intercepted the communications of individuals in the Megaupload case.

The Government Communications Security Bureau (GCSB) is an intelligence agency of the New Zealand government responsible for spying on external entities, much like the function of the CIA in the United States. It is forbidden by law from conducting surveillance on New Zealand citizens or permanent residents in the country.

The statement from the Prime Minister says the Crown has filed a memorandum in the High Court advising that the GCSB acted unlawfully while assisting the police to locate “certain individuals” in the Mega case.

Those individuals are believed to be Kim Dotcom, Bram van der Kolk, and their families. Prime Minister Key admits that the GCSB acquired communications without statutory authority.

Key says that he learned of the unlawful activity after speaking with the head of the GCSB last Monday and then took action to refer the issue to the Inspector-General, Hon Paul Neazor, who has the power to investigate matters related to the GCSB’s compliance with the law.

“I expect our intelligence agencies to operate always within the law. Their operations depend on public trust,” Key said.

“I look forward to the Inspector-General’s inquiry getting to the heart of what took place and what can be done about it. Because this is also a matter for the High Court in its consideration of the Megaupload litigation, I am unable to comment further,” Key added.

While the GCSB acting illegally is clearly an embarrassment for the government, Prime Minister Key now has some serious explaining to do. GCSB is a department that is responsible directly to him, a point not lost on Labour leader David Shearer.

“This is a shocking breach of New Zealand’s very strict laws restricting the ability of our spy agencies to snoop on people,” Shearer said in a statement this morning.

“John Key must also come clean about his claim that he hadn’t heard of Kim Dotcom until the Solicitor-General briefed him the day before the raid on the German businessman’s mansion. This is simply not credible given the range of people close to John Key who were involved in the Dotcom case.”

Shearer added that the Prime Minister would have been required to personally authorize monitoring carried out by the GCSB.

“He is responsible as Prime Minister for signing off all intercept warrants by GSCB. While it’s been revealed that ‘some’ bugging was done illegally, it is not credible to think that other monitoring by the agency was not signed by the Prime Minister before the raid was carried out,” Shearer said.

“This is not about national security. This is about John Key’s own word and whether he has told the truth to New Zealanders.”

Lawyer for Kim Dotcom Greg Towers said that since the matter was still before the court, he could make no further comment, but suggested that the revelations would have implications for Dotcom’s extradition hearing. Kim Dotcom added the following.

“I’m now a real life James Bond villain in a real life political copyright thriller scripted by Hollywood & the White House. I welcome the inquiry by [the Prime Minister] into unlawful acts by the GCSB. Please extend the inquiry to cover the entire Crown Law Mega case,” he said.

Dotcom’s lead lawyer in the U.S., Ira Rothken, said he is looking forward to learning of any US involvement in alleged domestic spying in New Zealand.

      I was about to applaud NZ’s PM John Key for his apparently brave and noble referral of his naughty spies to the Inspector-General, but then I read that the Opposition Labour leader David Shearer slags him off as being responsible for allowing this shit to splatter Dotcom and Megaupload :(

      The politics involved in this one case is now getting extremely complex with perpetrators acting unlawfully from Follywood to the USA’s CIA, to NZ’s PM & his CIA-equivalent.

         basically, what has gone on here is that the US government have been persuaded to do Hollywood’s bidding by those that were formally in US government themselves but who left and were given very good jobs by the US entertainment industries as reward for doing as much as possible to protect those industries and their execs and by getting new, draconian laws introduced that criminalized people for sharing information over the internet. once all that was achieved in the USA, they then concentrated on getting as many other countries to do the same thing, threatening those countries with sanctions or whatever if they didn’t do as told (not asked!). this is still going on today and shows the lengths these people will go to, not just to achieve the protections they seek worldwide, but to take control of the internet itself. what has been revealed as to what happened in NZ is extremely frightening! it shows the reach the US has and that it will corrupt other governments not just it’s own to get what it wants. how many other governments are involved? i bet all of them! the stupidity is that none of those involved in this despicable plot will achieve anything other than to be the USA whipping boys. once the US has what it wants, it will dominate all and no one will be on even footing with them. the even bigger shame is that none of these other governments gave a second thought for what they should have done or be doing now, protecting their own citizens and countries rather than grabbing ankles in front of the US. all it takes is for one to say ‘NO’. you may be surprised as to how many would follow. is being a ‘special friend’ of the US more important than your own people? it damn well shouldn’t be!!

          Plenty of people try to say no. I agree with you on most of your points.  However, you have to look at it from the perspective that the world is going to head in the direction of a single government because of things like the internet, and the majority of humanity being capable of only following.  The internet has made it truly “one world” in the sense that if you have the internet you are linked with everyone, everywhere.  If this is the case, and since I am an American I’d rather our flawed ideals over anyone else’s flawed ideals take the fore front.  The United States takes the most criticism as well, we’ve painted this image of perfection to other countries and now if we don’t live up to that image we are torn apart in the media, as often times we should be.  

          The U.S. is constantly ASKED by other countries and their leaders to interpret situations as well because for some reason they think we have a magic book with all the answers in it.  It’s not our fault that we take advantage of their incompetence to govern in their countries.  We aren’t going to tell them to do anything that doesn’t benefit us in some way, I mean like it or not governments are just businesses these days, it’s not good business to make decisions that don’t make you money or goods these days.  We need to have a culling of the herd in the government that’s for sure.  It’s way deeper than copyright infringement and debates over information and entertainment sharing on the internet.

        Agreed, Rob. Heads should be rolling over this and some people should be having criminal prosecutions done against them for this bunkus.

        I doubt that will happen however, because DotCom to some people is a ‘criminal’…. even though when you press them, they cannot name any law he broke once you point out that he adhered to the DMCA AND that he wasn’t based in America.

        New Zealand, from what I have read, doesn’t have ANY laws on the subject of ‘online piracy’ that I can find.

          It is illegal to infringe on copyright here in NZ which does extend to online piracy. We do have a 3 Strike policy here (although it’s only been used by the RIAA and only in a very limited way due to costs). You just would never have the potential for as high as a $150,000 fine for each infringed work. That said I would have thought that with all these illegal warrants/spying it would be starting to head to a default win for Kim. As far as I know any evidence collected via this spying is unusable in court as it has been collected illegally also.

        There was a British TV-movie called “Max Headroom” in 1987 that was about how corrupt the execs of the TV industry were, how they joined with the government to oppress the people.  When it was imported by Hollywood to film as a pilot for a dramatic series, they changed it so that there was a single evil television exec who lied to the “nice” TV execs and did all the terrible things the executives did in the TV-movie, except he did it all by himself.

    What surprises me is not that unlawful spying was done, when the US Administration does unlawful spying as part of their standard policy, but that the NZ Government is getting rather pro-active on getting this sorted out. It is also unlikely to be a whitewash investigation when New Zealand can make themselves look like a very nice law abiding country, with a great justice system, compared to the flawed law abusing United States. This Kim Dotcom MegaUpload case generates news around the planet and NZ is already putting on a good show.

    I most now look forwards to the findings of this investigation. This won’t be people burning documents in empty oil drums running around screaming “Burn everything! They are coming for us!” but it would be nice to see how far the USA managed to export their corruption and disrespect of the law.

    Well what can you say when not only was MegaUpload following DMCA law to a high degree, along with allowing major rights holders direct take-down access, but here is the US Government accusing them of major crime while doing a complete fiasco of this case with their total abuse of the law.

    Each story has breaks now is like an axe slowly falling. I can’t see how the US Government and MPAA can ever see this case ending well. It is clear to see that they totally rushed this case against Mega and ran off on a high degree of arrogance. Still that well sums up their War on Infringement for you when it is all about trying to bully the consumer market.

    I doubt the USA would ever do an investigation but you can at least hope they learn some important lessons from this case.

    I think this is the final nail in the coffin of the extradition case.

    It is unclear if voice/nugging took place or just use of the GPS location data to locate ppl for their arrest/illegal raid. Either way Once you step back and see evidence before the raid being illegally obtained, the raid itself being illegaland the unlawfully obtained evidence then being illegally handed over to the fbi . There is no way for a ‘fair’ trial’ and on the basis of this new evidence, dotcom should apply to the court for a dismissal rather than have to wait another 6 months.

    The US DOJ twisted and perverted this case from a civil copyright infringement case into a criminal case involving fraud and conspiracy to obtain an extradition yet so far the only legally obtained evidence has highlighted it is the US DOJ and its agents that are guilty of fraud and conspiracy not Dotcom.  Hardly the basis for a fair trial.

    Hopefully, after this we might finally see an end to US law enforcement acting on unsubstantiated claims of the MAFIAA and doing so in such a way as to bypass a defendants right to due process. The case from the start isbased on unsubstantiated MAFIAA claims that Mega was the world’s biggest infringer which is unsupported by the IFPI’s own data.

    The reasons why Mega was picked out are probably twofold. While the unsubstantiated claims of the MAFIAAmight act as a good excuse, the US Gov clearly wanted to fire a warning shot accross the bows of the cloud storage/computing industry. That required a big name to get headlines with the added benefit if a foreign company, illegally obtained evidence (even by US standards) can be laundered and presented as ‘legal’ if obtained via a foreign gov. They were never going to pick on major US players such as google or amazon for that very reason and that they clearly have the resources to fight back and the global and domestic revenue they generate.

      It may even go as far as watching this raid live on Kim’s on CCTV system after they hacked his systems to map out and plan the raid. The FBI also have copies of private communications that they need to explain.

      You do make many good points and you are quite right that it is hard to see how this case can proceed what with all the unlawful actions done by these US and NZ Government agencies. The only question is how long this case has to continue before these Judges say “enough is enough” when they have already said many of your points themselves.

          On another note I wonder where the FBI got hold of Skype conversations between Kim and others that Skype have stated that they did not receive any request from the FBI to hand over. So how did the FBI get hold of these Skype conversations if Skype never handed them over to the FBI. Something fishy there.

      Agreed – can’t see them agreeing extradition now. US case appears to be primarily built from MAFIAA innuendo and “evidence” that has been obtained illegally. I don’t believe that extraditing to US who WILL use illegally obtained material and are not even prepared to reveal the evidence (probably because it’s illegally obtained) can ever be seen as fair.

      Well, it could be the end of Key – hey was directly responsible for the department. Choices are he knew and lied about it or he was not in control. I suspect a little of both. The only possible reason for todays admission is that it’s coming out anyway. I would expect a lot of NZers to be pretty pissed off about 3 strikes, SOPA, TPP and so on without having to shell out monstrous damages for taking out Mega illegally. My hope is that this is a watershed moment where nation states relearn how to reject US neo-colonialism. it certainly should be.

    I wouldn’t be surprised at any length government and industry will go. Pirates have no concerns about whether their methods are lawful and the government is simply meeting you on the playing field you, yourselves, defined. Spin this any way you like for the “kill government” readers of TF.

    At the end of the day, pirates remain committed to using stealth, tech and whatever is at their disposal to make and keep and distribute digital merchandise they did not purchase and to which they have none of these rights. As long as this is defined in that way, pirates will lose until laws change. This isn’t very complicated.

None of which justifies the outright criminality in the Mega prosecution, or the corruption of the laws at the behest of Hollywood against the majority of society. Once it’s in the public domain, it will be shared. There are business models that work with this – we just don’t see dinosaurs like you proposing them. It’s 2012, not 1970. We have computers, the Internet and so on. Get with it. This isn’t very complicated.

      So put another way, you’d rather the government burn down houses to catch mosquitoes. Methods being lawful? The RIAA was the first to call copyright infringement “stealing”. The RIAA was the first to try and outlaw cassette tapes. The RIAA was the first to send settlement letters which may or may not have any legal basis (e.g. claiming that you are currently being subpoenaed, when you’re not actually being so).

      “Meeting you on the playing field”? Whatever playing field pirates allegedly set, the RIAA has long since exceeded that. They boasted about the number of letters sent out and realised months later it was a PR disaster before not publishing them. What happened? Tons of money collected that is never making it back to the artists who were allegedly robbed (meaning that it’s never about recouping artist losses), and only a few high-profile cases. Letting the RIAA run the playing field has been nothing short of a disaster.

      “Kill government”? No one’s asking for heads to literally roll. I don’t know where you managed to get that in this article.

      Any length government and industry will go? By your own words, you claimed that you witnessed pirates breaking laws in ever-decreasing cycles over the previous decade. If there is less lawbreaking, why is there a need for enforcement, and enforcement that is breaking existing laws and due process at that? So not only are governments burning down houses, they’re burning down houses to catch mosquitoes that might not even be there. And what’s all the more appalling is that you not only think this is okay, but you’re also commending such reckless behaviour.

      Why don’t you go back to whining about how our parents swapped mixtapes, or how the CD is pirate technology, alongside the jukebox and player piano. Or how about crying about the fates of glorious copyright defenders, Evan Stone and Andrew Crossley? Maybe you’d like papa Pelouzer to wipe some industry ointment on that HADOPIed butthurt of yours?

      Nope. We never illegally wiretapped people, conducted illegal aids, made up invalid warrants, or kidnapped Swedish ex-pats. The illegality of copyright infringement is a JOKE compared to all the insanely illegal shit that copyright gangsters pull in their futile attempts to stop us.

    The upside to all this for the NZ PM is that the NZ warships can now be berthed in US ports after a 3 decade ban due to the intransigence of the government of the day banning nuclear powered or armed US warships entering New Zealand waters. ‘Assuming the position’ in front of the US govt does pay off after all!

      If Kim Dotcom wins against extradition and NZ refuses to extradite him and the other 3 accused then I wonder what the US government will do in retaliation this time around.

        I suspect the end play will happen the moment NZ revokes Kim’s resident status, and he is forced to move to another country.  He will find himself facing the same charges again.  Sooner or later, someone will send him to the US.

        This case won’t go away.  Beating the extradition will just mean he will be a fugitive, and will be force to remain in places that don’t extradite to the US.  That makes for a pretty sad life for someone with the money and time to travel.
