Kim Dotcom Avoids “Unsafe” .Com, Picks Me.Ga for New Megaupload

Kim Dotcom has continued to supply more details on his new Megaupload project which is set launch early next year. Today he reveals that the new service will operate on the Gabon-based domain name ME.GA. In addition, Dotcom warns other cloud storage sites that it’s not safe to host their services in the United States, or use .com and .net domains.

Despite ongoing criminal proceedings Kim Dotcom and his team are gearing up to launch a new Megaupload, which will simply be called “Mega”.

The spin-off is set to launch on January 20, exactly one year after Megaupload was shut down. According to Dotcom the new Mega will be bigger, better, and protected against the wrath of the U.S. Department of Justice.

In previous weeks the eccentric file-sharing entrepreneur has revealed many details on how the new Megaupload will operate, but until now the site’s new domain has remained a secret. Megaupload.com is definitely unavailable as it remains seized by the U.S. Government.

Today Dotcom ends the speculation.

The new Mega will operate from the Gabonese domain Me.Ga. With just 98,800 Internet users in a population of 1.6 million, the African country is a small player on the Internet, but this is about to change.

In addition to avoiding domain names that are under control of the U.S., Dotcom also notes that the new Mega won’t partner with American hosting providers.

“Unfortunately we can’t work with hosting companies based in the United States. Safe harbour for service providers via the Digital Millennium Copyright Act has been undermined by the Department of Justice with its novel criminal prosecution of Megaupload.”

In a notice, ironically hosted on Kim.com, Dotcom also advises other cloud hosting providers to stay away from the U.S. and refrain from operating domains that are controlled by American companies.

“It is not safe for cloud storage sites or any business allowing user generated content to be hosted on servers in the United States or on domains like .com / .net. The US government is frequently seizing domains without offering service providers a hearing or due process.”

Megaupload’s founder is referring to the many domain name seizures carried out since 2010 by the Department of Justice and Homeland Security’s ICE unit. Some of these domains were seized by “mistake” and were later returned.

By avoiding .com Dotcom hopes that the new Mega will be able to operate undeterred. Whether the new service can live up to the high expectations remains to be seen, but Mega’s founder is Me..Ga.. excited.

“The return of the Jedi – May the Force be with us,” he concludes.

          If we are to give Wikipedia any credibility, .ga TLD is run by Gabon’s now privatized phone company, owned by Maroc Telecom, which in turn is controlled by the french company Vivendi, a telecommunication-media conglomerate. You might also have heard about Vivendi-Universal. Way to go, fatso.

          While any domain dispute would be run under Gabon’s jurisdiction, a small african state wouldn’t need more than a wink from big brother U.S. to shutdown the site. See the recent Cambodia vs. Sweeden TPB fiasco. Well, U.S vs. Gabon is like 100x that, and US is major oil importer from Gabon:

          Much better choices would be Russian Chinese Swiss (wikileaks), Venezuelean (Chavez), or Iranian domains. Neutral, large or american-hating countries. Have 10 or 20 such TLDs, advertise all, and you are bulletproof against any raid or take-down.

        Sexual preferences aside, it actually hits a much deeper level of problem, being that governments tend to regard certain bits of information equally as dangerous as the actual actions that flow forth from the information. e.g knowing how to make a bomb would be considered as dangerous as making a bomb.
        With the coming of the internet, information simply cannot be contained anymore, and the people cannot be kept stupid anymore. This is going to be a fight that’s might even get bigger than the whole copyright/intellectual property thing.

          Then as it happens I a UK citizen have been doing much VPN links to the US recently to make use of the US Netflix service. Even my 50GB monthly limit does not go that far in streaming much HD video but then I have been making use of the UK service in the rare case it has the media I desire.

    I am still doubtful to TF’s claims that this is the new MegaUpload when other news sites have not been supporting this claim. Also Kim Dotcom has made very clear that MegaUpload would not return until this DoJ case has been concluded.

    So this website sounds more like MegaEncryptedBackup to me where it would not be much benefit to the file-sharing community if sharing is not enabled. I have no idea about that when I have seen no details one way or the other.

    Welcome to the club Kim Dotcom when I have been telling people for many years to not use US hosting services. The US Government prying though all your files and communication is one reason but their modern total abuse of the law is another. As there are plenty of friendly countries around to welcome your hosting then you have no excuse and we should always remember to add an encryption level.

    I am most happy to see Kim fight back when a strong offence is indeed the best defence and to go on business as usual shows them they made no gain.

        When I visit me.ga I always end up at kim.com/mega/ which only seems to mention transferring and not sharing. Still it is nice to know we can move files from one person to another.

        Encrypting files in your browser prior upload removes all possibility of Mega scanning uploaded files for infringement. It seems to me he is totally abandoning DMCA law when it would violate other laws for Mega to open encrypted files even if someone did pass them the key.

        I doubt Kim Dotcom has gone insane and would allow Hollywood’s latest movies to be shared but just maybe the DoJ and FBI have really pissed him off that much to declare technological warfare.

        I think they should be scared when January 20 comes about when his cooperation days seem over and he is now on share what you want as he runs on high grade butt protection.

          While that is true many foreign companies do still comply with DMCA law when it has largely been a standard of fairness and with added safety for them.

          I fear this new me.ga site is a turning point that will one day render the DMCA law obsolete. Encryption is the future for users and sites alike and where Mega begins many other sites should follow.

          The DoJ and FBI have badly damaged DMCA safe-harbour protection and the things they now say in this case should be very concerning to cloud storage services and their users alike. Businesses love to be safe and protected under the law and where it would prove very tempting to step up their game with hard encrypted storage.

          Due to the MPAA and RIAA’s aggression they are likely to lose out big time when their checking of encrypted files will become painstakingly slow and there are a whole batch of laws to face concerning unauthorised access to protected secure files. So in the future if they sue people for infringement and those same people can sue back for hacking, computer misuse, wire fraud and such.

          Maybe, maybe not. If javascript is involved I would not consider the service secure. I would like to see Mega release an open source stand alone app for the encryption instead of using the browser ( but I can’t see him being that concerned with security of the users data, just plausable deniability for his business and partners. Go on Kim, prove me wrong! )

      The DOJ claim that Dotcom may be in breech of his bail conditions if he launches a new Megaupload because he stated that he wouldn’t return or re launch the company until the case has been concluded. Well how can Dotcom return or relaunch Megaupload before the case has concluded when the US government have completely seized the company and refuses to release it. It is totally stupid of the DOJ to even claim that more charges will be brought against Dotcom if he goes ahead and (re)launches Megaupload whilst he is on bail. The new Mega is a completely new business but the DOJ will no doubt make a complete nuclear uproar with insisting that this is just a (re)launch of Megaupload and will no doubt get the prosecutors in NZ to bring more charges ie. breeching bail conditions with this. I am sure that Dotcom with his lawyers will have made absolutely certain and sure that this new Mega business will not be in breech of any bail conditions before the go ahead of starting the new Mega business and I hope that this will all back fire and blow up in the DOJ and NZ prosecutors face if/should they try and bring any charges of breech of bail conditions against Dotcom.

        He’s not bringing back Megaupload, he’s creating a new business. That’s the stupid thing about the restriction they put on Megaupload / Kim. Had they said something to the effect of “no storage site”, they’d have been ok. However, as long as he starts something that isn’t called Megaupload, he’s basically ok. I mean, a website is just some code and servers, technically nothing is “the same” as anything else, as long as the code is different.

        Samsung has proven this stupidity many times: sales of Fancyphone 3 FTL banned, so they release a Fancyphone 4 FTW that doesn’t have the infringing features of the first one and sell it without issue. Megaupload just needs not to operate a service called Megaupload.

      Dotcom gave certain movie studios direct access to the Megaupload system before whereby they could delete the infringing files themselves but still Megaupload was shutdown over infringement. Hope this time around they don’t turn around and sue him.

The one and only United States of America – Guess what company is in there?       You are wrong. The USA government only has the authority to seize domains of .us, .com, .net, .org, .biz, .info, and other generic TLDs. This is precisely the reason why they tried to get SOPA passed… because all of those non-US domains like .ru, .se, .ua, etc. are untouchable to the DHS/ICE because it’s out of their jurisdiction. Just look at all of the DHS/ICE domain seizures to date… NONE of them have been foreign domains. The only way to get a foreign domain name taken down is through international cooperation from the country that’s administering it.

      In your example of Wikileaks, last time I checked wikileaks.org is still up and running. Since it is a .org it is under US jurisdiction, and therefore yes – it COULD get seized by the government if they chose to do so. However, if it was wikileaks.uk, then the US would try to pressure them, but ultimately it would be the responsibility of the United Kingdom to implement the seizure/takedown.

    It would be safe if America adhered to the laws that they passed. The DMCA specifically absolves ALL companies of liability if they adhere to the DMCA “notice and removal if no counternotice” scheme.

    The whole MegaUpload takedown was a clusterfuck of obscene proportions and still is growing.

    Much depends on whether the new Mega’s underlying premise is perceived as infringement by its users and observers. The governments are making quite clear facilitation will be illegal going forward and those involved in serving infringement will be apprehended and punished. If DotCom’s predicament isn’t clear, consider Gottfrid Svartholm.

    Maybe pirates will finally get it that government and industry will define taking without paying as a form of digital theft and piracy will cease compromising our freedoms. Maybe the appeal of getting stuff for nothing will prove too great for pirates to resist and we’ll have government up our asses for piracy’s greedy selfishness. Either way it’s a pleasure watching folks trying to find ways around existing law while governments pass new laws in reaction. You get free stuff by copying without paying. They get to hold you in solitary confinement.

      MegaUpload was legal, DMCA compliant, and gave rights-holders the power to directly delete infringing user files. What the U.S. government has made clear is that they don’t give a fuck about their own safe harbour laws and will take down a fully legal service if their copyright industry masters tell them to.

      Which isn’t working out well for the DoJ – it turns out there are some consequences for taking down a law-abiding business using illegal raids, false search warrents, and spurious criminal charges.

      The government and industry can call filesharing “theft” all they want, but that doesn’t make it so. Actually, it only makes them liars.

    As much as Kim Dotcom likes to paint himself as a martyr and complain about internet regulation in the United States, he clearly broke copyright laws and deserves to be prosecuted for his actions. It is hardly surprising that he has the audacity launch another website aimed at illegally downloading copyrighted materials during his ongoing criminal proceedings, but Kim would be smart, and lucky, to simply drift into retirement.

      2. NZ authorities unlawfully seized Kim Dotcom’s property.
      3. NZ authorities unlawfully refused to return falsely seized property that had nothing to do with the case.
      4. NZ authorities unlawfully exported evidence without court approval.
      5. NZ authorities unlawfully wire-tapped NZ citizens.

      1. Kim Dotcom broke copyright laws.
      2. US authorities unlawfully seized 3rd party property.

      I can’t wait for US documents to be unsealed to uncover yet more of their unlawful acts but what is really going on here becomes more clear as each day passes.

        I think that the Proven (pending an appeal) has already now been upheld by the court of appeals and has agreed with the previous rulings. The only appeal currently be dealt with at the moment by the appeal court for which they are now deciding on is the matter of having to give fuller disclosure of evidence of the Megaupload case before the extradition hearing. I can’t wait to see what the US government will come out with if the appeals court upholds the ruling that they MUST give fuller disclosure of evidence. If they don’t comply to the ruling if the appeal court upholds it I hope they are found to be incontempt for refusing to comply and the extradition is refused.

          It is likely though that they will keep appealing this matter all the way up to the supreme court simply because they have a weak case and want to delay the progression as much as possible.

          As things stand the DoJ and FBI are lawfully required to disclose all evidence related to the extradition case before the extradition hearing in March. So they now have 4 months to sort themselves out and to show why Kim Dotcom and Mega are in the position that they are in now.

          I’d guess that if they fail to give fuller disclosure to the NZ court, the extradition request will be thrown out by the court. That still leaves the FSA* and their MPAA masters more or less where they want to be, because Megaupload is shut down, users’ files are not available to them, and they’ve seized megabucks of Megaupload money.

          @Violated The appeal against the disclosure of evidence that the US must give fuller disclosure of evidence was being appealed by the prosecutors. The appeal is being dealt with at the moment by the appeal court and will give its ruling anytime now. If the appeal court agrees with the ruling that fuller disclosure of evidence must be given before the extradition hearing then Dotcom will have scored another win as he will be able to see fuller evidence against him. Whatever the appeal court decides I don’t know if this can be appealed as this is being dealt with in NZ and the High Court has already decided on this matter which has now been passed onto the appeal court because the US appealed the decision. So i think that this can’t be appealed anymore whatever the appeal court decides and therefore the ruling is final. If fuller disclosure of evidence have to be made I can see the US trying to delay the time in providing the evidence or the evidence they give will only show Megaupload in a bad light and any evidence of wrong doing from the US side and evidence that shows Megaupload in a good light will not be handed over.

    It needs a country to break ranks. To put citizens before copyright. To admit that citizens should be sold product, that “licence” breaks our rights. And that citizens can share their products FOR NO REWARD if they so choose.
    Also, take away the rights of digital copyright holders to decide on channels. They have to put it out there and anyone can sell it at the margin they choose.

    I would expect that the new mega would probably have mirrors in some of the traditional harbors like Russia and Swiss etc. One thing in a small country it is relatively easy to buy protection. It would be unlikely that the US would give a large aid package to a small country just so it could take down a website and before could even be organized the site would be long gone.

    I have many terabytes of data on drives that I would love to mirror in cloud services as buying drives and copying is way to expensive I have great need of a cloud service that is bullet proof and won’t quickly go out of business or be shut down because some use it for piracy.

    This industry will eventually mature but just like most manufacturing this is an industry that will be forced offshore. The Us in its its ambitious attempts to control copyright is committing digital suicide. Already because the US government has not demanded the industry double or triple internet speed to keep up with the rest of the world us internet speeds are slow by most standards in most of the developed world. By destroying safe harbors the US is destroying the cloud business. I have a friend that has thousands of cd’s. I could rip them all and put them in the cloud for him but what if the government took down the hoster and claimed his files were copyrighted. True they are but in this case he had the right to rip them for backup and use the back up method of choice regardless of whether they could be made available to others or not.

    This brings up the final point about data being illegal. Data by itself is not and never has been illegal. The possession of copyrighted data is not a crime anywhere the laws only say unauthorized transmission or unauthorized reproduction for distribution for commercial gain. No where in the law is the data actually defined as illegal. It bothers me in any article where the data is referred to as illegal. Data is not a goddamn drug and is not illegal.

    it wasn’t admitted that any sites that USA ICE and DoJ shut down were done so by ‘mistake’. when you consider that it took over a year for some of these sites to be allowed to get back up and running, it shows the absolute contempt that the USA has for anything it doesn’t like, the lengths it will go to to please their own entertainment industries and the fact that they will and frequently do break International as well as their own laws just to achieve what they want. as far as the site shut downs are concerned, the object of the exercise was to do as much harm as possible, hoping that the financial damage would prevent the sites from reopening, even though it was fully recognized that the action was illegal.

Any one with a satelite internet connection can get the new ip and new Keys to the safe krypto tunnels, those users will then spread the word to the rest of the internet, like TPB on steriodes, and when his at it lend some bandwith to the TPB…
