Megaupload Targeted In Multi Million Dollar Lawsuit

Adult media company Perfect 10 has come out all guns blazing in yet another lawsuit adventure. This time it has targeted cyberlocker Megaupload, with claims that the file-hosting giant infringed its copyrights, infringed and damaged its trademarks, and engaged in unfair competition. Perfect 10 demands a jury trial and damages and costs running to millions of dollars.

Another month, another copyright lawsuit from adult media outfit Perfect 10. This time the company is chasing file-hosting service Megaupload and its owner Kim Schmitz, associated companies such as megarotic.com, megaporn.com, megavideo.com, and megaclick.com, and other businesses and affiliates.

Does 1 to 100 in the lawsuit, which was filed 31st January in the California Southern District Court, are described as businesses owned, controlled by, or affiliated with Megaupload “which either directly or indirectly profit from and/or directly or indirectly infringe or facilitate the infringement of Perfect 10 intellectual property.”

The complaint states that Schmitz created MegaUpload for the specific purpose of storing, displaying and distributing intellectual property owned by others including “billions of dollars of pirated full-length movies, songs, software, and images.” It adds that Megaupload is not registered to do business in the United States and pays no US taxes.

Through its rewards program, which Perfect 10 claims offers $10,000 USD for 5,000,000 reward points, Megaupload “induces its customers to post content that is likely to be massively downloaded, such as high quality infringing nude images and popular full length movies and songs.”

Furthermore, Perfect 10 believe that Megaupload does not deserve ‘safe-harbor’ under the DMCA.

“Pirate websites such as megaupload.com, which obviously infringe massive quantities of movies, songs, images, and other extremely valuable copyrighted works, and directly profit from the infringing activity over which they have complete control, were never meant to be eligible to receive a DMCA safe harbor,” states the lawsuit.

“Furthermore, none of the five Megaupload websites listed above, including megaupload.com, identify the name, address, or phone number of their respective DMCA agents as required by 17 U.S.C. § 512(c)(2).”

Nevertheless, Perfect 10 says it sent Megaupload 22 notices in July and August 2010 informing the file-hoster “that it was infringing a vast collection of third party copyright works, Perfect 10 rights of publicity, and Perfect 10 copyrighted works.” Perfect 10 states that “as far as it can determine” most of the works have not been removed.

This has led the company to sue Megaupload for direct, contributory and vicarious infringement of “tens of thousands” of its images. Among other claims, Perfect 10 states that Megaupload also infringed and damaged its trademarks and became a source of unfair competition.

Perfect 10 is demanding that all defendants cease the unlawful copying, distribution and displaying of its copyright works and the same be deleted along with any links to such material between the defendants’ websites and their affiliates.

Damages of at least $5 million are claimed, plus punitive damages, attorney’s fees and full costs.

In 2009, Perfect 10 filed a lawsuit against the leading file-hosting service, RapidShare. Among other claims, Perfect 10’s complaint stated that RapidShare was guilty of infringing the copyrights of many of its images. In May 2010, the District Court of California ruled that RapidShare was not guilty of copyright infringement. RapidShare went on to countersue Perfect 10 “for being a copyright troll.”

Update: Here is a statement from Megaupload sent to TorrentFreak a few minutes ago.

We will file a motion shortly to dismiss the case. Our legal team is confident that we have nothing to worry about and they are working on a counter suit.

All infringing files Perfect 10 has ever reported to Mega have been removed within hours. We keep track of all DMCA notices and could identify all notifications from Perfect 10 and we have verified that all reported links were disabled within hours.

We also removed a link to content by the artist “Christina Aquilera” which was reported by the owner of Perfect 10 Mr. Norman Zada. But we doubt that Perfect 10 or Mr. Zada own the rights to works of that artist.

        Except Perfect 10 owner Norm Zada doesn’t send out valid DMCA notices.

        From TF’s article on the RapidShare case:
        “RapidShare claims that Perfect 10 has failed to inform them of the location of the infringing material on their servers. If it knew where the material was, the file-hoster said it would willingly remove it. Zada shrugs off responsibility for that work.”

        In Zada’s own words:
        “It’s not my obligation or up to me to spend time finding those links. That’s not my problem.”
        The Digital Millenium Copyright Act says that it actually is his responsibility – if he hasn’t changed his tune, he will fail again. :)

    Since when has the United States been consider an international court of law. under which provisions in the WIPO treaty enables the united states to export DMCA as international law.

    If I’m not mistaken megaupload is based out of Hong Kong therefor megaupload has no requirement to identify a DMCA agent or take down any material requested under a DMCA complaint. Furthermore it makes forcing the company to pay fines almost impossible. It seems to me to be more of a politically motivated move. I’m sure they will lose in court regardless.

        How did you get that he was talking about Megaupload losing? To me it seems since Perfect 10 is trying to get Megaupload to pay, and his statements prior to “I’m sure they will lose in court” are obviously pointing to Perfect 10, I assumed he meant P10 will lose…

          Just to clarify I w as talking about Perfect 10 losing its case. The safe harbor provisions under DMCA allow for companies to operate file hosting site. If this case is anything similar to the rapid-share case which I’m assuming it will be the California Southern District Court will rule likely rule in megaupload favor due to the rule of precedent.

          I like how perfect 10 mentions third party rights in its suit because that is completely irrelevant furthermore Megaupload has no legal obligation to take down any files requested under a DMCA take down notice because Japan is a sovereign state and US law does not apply. An intelligent lawyer would argue that those files that have been removed have been done so under the terms of use and is in no way an omission of guilt.

          In all honestly if i was working for mega upload i wouldn’t even how up in court i see no real point.

    Because their nasty gay content is not so much popular they decided to make money from file hosts…claiming ridiculous amount of money. It’s very idiotic – this miserable site perfect10 – do it makes million of dollars to pretend such loses?!
    Otherwise I got by mistake one of perfect10 ‘DMCA’ notification: obviously they send spam emails to multiple emails without any sense!
    They stated my site (I dont have a site!) got “unfair competition” – they stated on my site there are multiple links to Michael Jackson, Maddona, etc?!?!
    WTF?!?! I believe DMCA must be sent only from legitimate copyright owner or his agent?

    If I owned them, I would stop removing any suggested DMCa takedowns. They have no authority and it doesnt make any difference to being sued or not.

    I think the whole idea is they know they wont see a penny so they are going after the domain names and know the yanks will take down domain names even when the company is 100% legal and has nothing to do with the US.

    Why do people who file copyright infringement making it sound like we just barge in to their offices, with our external hard drives, sucking their data, and then destroying their servers with that data along with it? The only thing that is “damaging” is their precious wallets, obviously.

    We as the consumers, reserve the right to determine what is best for ourselves, not for the businesses to determine that for us. If they want our money so bad, then they should quit trying their hardest to make the quality piss-poor and out suing many just so they could get money.

    Only then will they figure it out the hard way, why we’re no longer buying their stuff.

    PUT an alleged illegal file up and behind such.

    NOW do not tell the judge or them the password.
    NOW how do they know its there? HOW do they know?
    Ya tell the opposing lawyer ok show us the file now.

    HA you cant so what basis of proof can you say anyhting is there that we are responsible for, that some user isn’t and you need to go after them not us.

    so Mr. Zada has filed a DMCA for something he does not own.

    This is exactly the kind of action that doesn’t endear copyright holders to governments. Carry on wasting public resources launching frivolous lawsuits, and the law will be changed to stop this kind of activity in the future.

    TBH, I’m surprised the porn industry are so far behind on these actions, they were usually the ground-breakers when it came to Internet technologies. Were it not for porn, banks would have never worked out how to implement online banking facilities.

    Bankers really do rely on wankers.
