Busted Movie Site Pleads For Cash To Fight Feds

At the end of June this year, nine sites connected to movie streaming were targeted by the U.S. Government. The operator of one of those sites, NinjaVideo, has now issued a plea for funds to fight back against what is undoubtedly a formidable force. “We are looking at six to seven digits and it’s going to be pure hell,” she explains. “We have nothing. Nothing at all. They took… everything.”

By now, you know the background. Last month “Operation In Our Sites” targeted nine domains connected to the offering of first-run movies without consent from the copyright holders.

The authorities moved to seize several domains including TVShack.net, Movies-Links.TV, FilesPump.com, Now-Movies.com, PlanetMoviez.com, ThePirateCity.org and ZML.com. US Immigration and Customs Enforcement’s Homeland Security Investigations (HSI) also seized assets from 15 bank, PayPal, investment and advertising accounts.

The operators of two other domains were also targeted – NinjaVideo.net and NinjaThis.net. According to authorities the site had been subjected to a months-long operation. This is something TorrentFreak can confirm. Following a tipoff from a very reliable source, we informed NinjaVideo months ago that they were being watched and their hardware was being interfered with. It’s almost certain that they were powerless to do anything about it.

Now, the charismatic and somewhat larger-than-life leader of NinjaVideo, a young woman by the name of Phara, has returned to the spotlight. Never one to understate an issue, Phara is known for her forceful leadership style and colorful, often dramatic writing on various site issues from the small, to the very large.

The seriousness of the situation she currently finds herself, however, is off the scale.

“We need you. Our lives, our very freedom depends on this. We can’t do it alone,” pleads Phara. “We have nothing. Nothing at all. They took… everything.”

“Precedents are being made upon our heads. Never before has a site like ours been targeted in this way. We ask you… if you are vested in this case, this landmark case on the future of Internet Sharing and Internet Rights, that you speak to your friends, your family, your co-workers, your bosses,” she continues.

The gravity of the situation is clear. There can be little doubt that the U.S. Government will seek to make a very large example of NinjaVideo’s operators – a likelihood which doesn’t escape Phara. To this end she is calling for heavyweight help.

“Perhaps you are affiliated with the ACLU, Google, Youtube, MegaUpload, Rapidshare, The Pirate Parties around the world. Perhaps you are financially comfortable and you feel passionately about the issue at hand. We need… NEED… legal sponsorship in addition to legal donation,” she pleads.

“Perhaps the future of your own site is at risk and it is this case that will put it in the crosshairs of the next raid. Perhaps it will be you who will see your home, dear lord, your home, ripped apart by THE DEPARTMENT OF HOMELAND SECURITY.”

NinjaVideo was a free resource and never took money from its users but due to the unbelievably difficult situation its operators now find themselves in, pleas are now being issued for people to donate to the site’s fighting fund.

“We are up against the Federal Government of the United States. They are petrifying. PETRIFYING,” concludes Phrara. “And they are backed by Hollywood. And they have chosen us to be an example. I think you understand how much money is on the other side.”

Lots. Lots and lots of money. There can be little doubt about that. Phara fears the worst.

“They want to cage us. They most likely will,” she warns ominously.

“Please don’t let them. All it takes is $1 from each of you.”

In return for large donations – four digits or more – Ninja are offering benefactors a prominent position “behind the scenes”, presumably connected with defense. What these positions entail exactly remains to be seen.

“Your prayers, your posts, your words, your art… your support in general is priceless. Unfortunately, in the world we live in, it will be your money that gives us a fighting chance. The former gives us the strength to close our eyes and take it one breath at a time, the latter gives us the opportunity to take that breath outside of a prison cell,” Phara concludes.

“We love you, NinjaVideo. We always will.”

    So… you didn’t upload all your videos with your site tag all over them.. yes you did.

    No matter what is donated, it will cost a fortune to fight and wont change the outcome what so ever.

    I wish phara wasn’t going to prison, but it was a ticking time bomb.

    The legal system is funny though, they raid your home and your banks. Take your money, then expect you to pay for a expensive court battle.

    have said many times that unless companies, websites etc amalgamate to fight as one, this type of thing will not stop! the next site could easily be yours! it doesn’t matter that a site is offering files for free or not (unless it is RS, of course), you can be targeted. and all because the money already in the pot of certain corporations is not enough and them not being prepared to offer things how people want. in other words, pure greed! this action has been bought, like many others. how on earth can file sharing, in the ‘normal user’ sense, be a threat to National Security? the general public are teetering on the brink of being completely restricted in everything they can do, not just on the internet, with no way say in the matter. once something is lost, it is a hell of a job to retrieve it!

    why don’t you now release your source code to the open source community? why is it when every site goes down they keep their source to themselves where it does nothing only sit on a shelf gathering dust…

    why not give the source code to the people who donate so they can continue on with your fight!!

    i wish everyone would do this when they shut down people cannot continue to clone and copy your sites to carry it on if there is no tools software available to site owners.

    example take newzbin only for the new people hacking the site to steal the source code/base no other sites like newzbin could or would be created

    when are people going to learn … if newzbin released the source you would now have 10000′s of site/clones available making the hydra bigger and bigger every day just like it is with tbdev/gazelle

    without these torrent scripts no sites could/would exist why is it people don’t realize no source code available no sites can pop up

    The one who ruin the artists are the Record labels, production companies, the distributors, the retailers and the marketing agencies… By the time everyone has taken his cut, the artist is often left with nothing.

    I remember a Canadian artist who sold 250,000 albums and 40,000 DVD. She went on TV and admitted that she did not have enough money to buy a house… Because the “industry” took the largest part of the money.

    The artists should first worry about making the industry pay them a reasonable amount for each CD sold, after they might want to worry about the albums they haven’t sold…

    A better legal system would be one that tries it’s best to ensure equality and fair game.

    This means no amount of money will matter.

    What should happen are lawyers that work directly under the courts. No private operations or ownership.

    Lawyers build up stats printed on a neat collectible card and they are pitted against each other…like a RPG game where a level 10 lawyer can compete with a level l5 to 10.

    Now is this not a Utopia like Legal system?

    I agree with you though, a just legal system would provide the defense the same amount of tools and resources as the prosecutors get. The only problem with that is most lawyers are motivated by money, take it away and they might not want to bother defending you to the maximum of their abilities…

She has constantly bragged about the scene and knowing people, when for one the main scene dispise the uploading of the content they post for free as well as making money off of the concept of it all. You do realize a large amount of people hate Phara and all her brian washed drones. I remember a year ago her and others daily trolled ovguide to give it 5 ratings constantly, and I noticed others talking about spyware in the Applet they used, I looked into it and posted the method on the comments to eventually being threatened and harassed, all because I found the method they had used which in the end was stolen from another open source project, soon after they started obstructing the applet with the new methods. Also with Phara’s childish admin banning, all she wanted was for people to keep feeding her ego. I still have the podcast of her talking about her life, and another where she bought a new tv and ps3, probably with the funds from donations and advertising. If you support her, you support the downfall of the scene. The content the scene releases is ment to be free and not commercialized for profit, if you knew anything you would know that as fact. I for one support pirate bay, because they fight for torrent user’s all throughout the world, but in ninjavideo and Phara’s case, it’s all to save their own asses.

    Unfortunately, it does look like the evidence against her is staggering. I’ve never used Ninjavideo before, but I do see why people should support her. As file sharers, there is always cheering for the success of those being targeted. Even though this was poorly planned, she is still on the side of file sharers.

    However, at the same time, a disaster plan wasn’t even in place, and no matter how much money is donated, this is like trying to swim up a waterfall.

    Honestly, I’d say this is best left up to each person’s discretion to support her, but I’d hope she’s built a loyal ninjavideo community, as outside of them, I don’t see too much support.

    At the least though, we should all wish her luck in this case, regardless of what we believe. She is on the side of freedom, if a lot closer to the line than the rest of the file sharing community.

    but the admins or sysops of such sites esp if they live in that evil land should know how to shell their servers over 5 or 6 networks and neva eva post IRL info or pics!

    Now for my part. From what I’ve seen here it’s not like NinjaVideo had a strong warm community. If that’s the case maybe she’s doomed. It’s different when the community you built loves you. They will support you no matter what. I’m part of more than one sharing community and there’s one specific that I haven’t donated yet because I couldn’t. They disable the donation section whenever they reach enough to pay for the servers.

    On the other hand, even if she’s an idiot and the community wasn’t that warm, it’s one more reason for donating since it could be a strategy from MAFIAA rotten bosses to set a precedent easily in court. It’s fairly simple: get a somewhat big site that doesn’t have much support because the founder is not a nice person and sue the hell out of the admins appealing ad infinitum to crush them financially and set a precedent to bring many others down.

    Got my point? Maybe it’s a good time to support NinjaVideo. And maybe we have yet to see what the other big shots in the file sharing community will do. The Swedish Pirate Party threw some really heavy artillery recently. We’ve seen TPB, ISOhunt and so on supporting (even if only at distribution level) bt/pirates funded shows/movies. The stage is set, the players are moving.

    I never used NinjaVideo, but it sounds like (from the comments) that they got scene content and uploaded it to their own servers for personal profit. That is a lot worse than what TvShack does, where they just use links.

    Ovguide took the site of there front page because of what they were doing. And of course NV’s admins and others said ovguide had a grudge against them or something simular… any wonders why that is then.

    It’s not, that’s the entire point of taking your cash. They do it intentionally to help cripple any legal defense you might try to mount, leaving you to rely on public defenders and pro-bono attorneys.

    See, the US government decided that it was too hard to successfully prosecute rich drug dealers, so they passed a law allowing them to seize pretty much anything and everything that the drug dealers own, even without a trial or any real proof. Since then asset seizure and forfeiture laws have been expanded to cover just about anything that the government wants them to cover. So not only can they make someone destitute without ever charging them with a crime, if they do decide to charge them, the person will have no money to defend themselves.

    The “freedom” in the US no longer applies to the people, only to the government.

    Thanks for getting those pics out – I’ve seen them all before and I think they’re great. People need to see that she’s just a person like the rest of us and you might not like her or the site but tens of thousands of us do. But its the ’cause’ that we’re fighting for – we believe that Ninja was unfairly targeted and that the government is overreaching. Great article torrentfreak!

    I’m more laughing at that “not a warm community” section, just because it wasnt clearly flaunted that there was no community doesn’t mean there wasn’t one, hell there still is, people from before we got shut down and even after all supporting well, just because you weren’t taken a liking to does not mean its a cold community, just your more than likely an arsehole.

    Stand by Ninja, it had over 6million viewers a month, it can’t be that small and/or insignificant. It had a reputation for getting highest quality streaming content up, and fast. All those “other sites” that people suggest to as alternatives, don’t offer half of what Ninja did, and the ones that come close, are pretty much wannabee clones.

    You could build a great unite and stand for what you do instead of hiding and bashing.

    Interestingly since the take down other sites add worst ads, so being redirected wasnt the worst, but go on an ad journey to watch something seems much lower to me.

    About the photos – if you would have cared to even explore the site/forum you would have noticed that there were tons of pics from her, so she isnt an ominous cyberentity. And if you had gave it a try you would have understood and highly apprechiated that there are strict rules. Those are not to bash anyone but to protect ppl there from ppl who cant control their expression.

    And if I would be Phara I would consider to take all my knowledge about the scene to show you what pain and grief you give me instead of seeking alliance.
    You may not be a big fish in the sea but I would make you understand and feel like I did when this shit happened. And I would care for you like you do for me.
    And for all leechers who spread poison words I would work extra hard for you that even the smallest place you could get your sh** from is shut down.

    So It’s clear to readers that NV admin had everything taken by the Feds and now they are begging for $$$. What are they doing themselves to help raise $$$ for their legal fund? Sitting around on the Internet brainstorming ideas to get people to give money. Perhaps they should go get some “legitimate” work and start contributing themselves. Perhaps they should have been setting some money aside from all the previous donators to NV instead of using it to bankroll vacations to Greece and month long trips around Europe.

    I have absolutely no sympathy for sites like that. There is a big difference between doing something out of idealism, and doing something because it is popular and profitable.

    NinjaVideo ran a ton of ads and solicited money from visitors, some of which paid for the site expenses, but almost certainly a non-negligible portion went directly into admins/staff’ pockets. I have seen it too many times with private trackers where they beg and plead and threaten to close the site if donation quotas are not met, and it disgusts me.

    I know first-hand what it costs to run a web site, I am a programmer and network engineer by trade. It is cheap! Most importantly: when it is cheap, it is much easier to hide one’s identity. If there is no money to follow like bread crumbs, the risk of getting busted is much lessened. When you or someone near you gets greedy, your site becomes a highly visible target, and while I don’t know the story behind NinjaVideo, the telltale signs are simply too obvious to ignore.

    They are not helping the cause by being black hats. They got what they deserved.

    I never even saw the site. Had a quick look at the forums and it was like all the morons of the internet had finally found a home. Adobe should get involved as theres plenty of pathetic signatures all over that forum no doubt created with pirated copies of thier software.

    Its because of rubbish sites like this that the government is forced to take action.. whatever happened to hidden, passworded IRC #’s with exploited pub FTP dump servers.. people who can only use facebook and email should have no access to “piracy” – its because all these profiteers chasing money have dumbed it all down that the governments have to act.

    I’m not sure about Ninjavideo but it it is like the other sites that got taken down in this then all of these bashers are full of BS. I checked the sites that came back up after being taken down and they had virtually no adds and I couldn’t see a way they were making profit. The only adds I saw were the adds in the videos which were from the site that the videos were stored on and not the site you were on.

    Billco: Do you really know the costs of running a website that has millions of views per month; and that has complex scripting that would be needed to be able to embed streaming videos from many different sites into said site? If you don’t know the costs of running that kind of high bandwidth site like that then you don’t really know. The larger and more complicated the site is and the more users it has the more expensive it costs to run it.

    Sorry, but what the hell am I reading.
    Embedding a flash video from another site into your page is dead easy – even if the other site has restrictions and what not.
    Only costs NV would have incurred is bandwidth, hosting and time.

    With the amount of traffic they get – and seeing as all the videos NV offers is leeched off some other site’s bandwidth – I would say they could run the site on one dedicated server with a 100Mb connection.
    Assuming they bought a server themselves for £500, that would cost around £50 a month to host.

    £50.

    The ads alone from that many hits would be probably in the region of a grand.

    So doing the obvious maths, the site would be making a lot of money.

    Of course, the NV team would have to invest a lot of time into the site to keep the links fresh… but srsly…. where they running NV as a business or as a little project on the side?
    I’d donate to keep a healthy community alive, i’d donate to keep a non-profit team of coders working on what they loved. I’d even donate to stick it to the MPAA/RIAA.

    But it seems to me that NinjaVideo is none of these things. They’re just a group of kids who learnt how to code, realized how easy it was to make/host websites, then profited of piracy.

    In short, get bent Phara. I’d rather donate my spare change to Apple or Microsoft.

    guys, i know nothing about NV, never used it, not a member, never heard of it until now, it’s just a matter of principle to me, where will it stop if they lose? no matter what you think of NV, your favorite site could be next. i made a small donation, and if someone starts poking around in my PayPal account, they’ll be the ones in court, i haven’t downloaded anything, I’m just giving money to a friend.

    I personally would not support NV in anyways, from the way NV have always treated its users.

    1) Karma… they saw it coming when they try to make a site that earns profit for you and not based on the good old file sharing spirit. Don’t expect the public to save you when all you did was spit on them when you were all high and mighty.

    2) Not having a backup plans or extra cash to save themselves when something goes wrong is an epic fail. They should have expected it and not cry for six to seven digits of donations. NV != TPB , dream on for that amount of donations. For people considering to donate, this is an endless pit, I’d rather donate it to some charity foundation not to NV.

    I don’t personally think very much of NV or Phara. As a matter of fact, I think that she was a nasty lying bitch. She made hacking threats on several occasions, had a hand in various questionable activities, and claimed to know people in the warez scene. Two words: drama queen.

    Worse, these people were fucking idiots. They hosted their servers in the United States for God’s sake! They never took any serious measures to protect their identities or keep a low profile. They ignored warnings from TF and others. They did not believably attempt to remain in a legal gray area. Uploading videos to another site, linking to them, and profiting from the advertising is clearly a violation of the law. Now she is desperately attempting to get your hard-earned money to waste on a pointless defense of her crimes.
