New Zealand Government Rushes Through Controversial Anti-Piracy Law

The New Zealand government has surprised the public and even some MPs by moving to rush through its controversial 3 strikes-style legislation today. The new measures will allow for users to be disconnected from the Internet for up to 6 months, based on infringement claims from copyright holders.

In a surprise development, during the next few hours New Zealand’s government is to rush through legislation that will target Internet users who share copyrighted material online without rightsholder permission.

The Copyright (Infringing File Sharing) Amendment Bill, which unanimously passed its first reading in Parliament in April 2010, will put in place a 3 strikes-style regime, whereby Internet service providers will be initially required to send warning letters to alleged infringers at the behest of rights holders.

New Zealand’s Copyright Tribunal will be empowered to rule on cases of alleged repeat infringement and will be given the authority to hand down fines up to a maximum of $15,000 ($11,733 US).

For repeat offenders, a six month period of Internet disconnection may be applied, a measure too far for Green MP Gareth Hughes who wasn’t even aware the Bill was coming up today.

”It really surprised me because we haven’t debated it since November,” he said.

Hughes later confirmed he would request an amendment to remove the suspension clause but a spokesperson for Commerce Minister Simon Power said it would be opposed. While the Greens are against disconnections, they supports the Bill in principle.

Today’s second reading of the Bill is being accompanied by a Supplementary Order Paper (SOP) which in part is aimed at clarifying burden of proof issues in a current clause.

According to intellectual property lawyer Rick Shera, the clause created a presumption in favour of copyright owners and the changes being considered remove the reference to the presumption of guilt being “conclusive”.

“I do act for a number of copyright owners, I can’t see why there is a need for a presumption, I mean if copyright owners are sure of their evidence then they would simply submit that evidence to the copyright tribunal,” Shera told NBR. “The tribunal is perfectly capable of weighing up whose evidence is better, that’s what tribunals do all the time.”

The Bill is expected to pass its third and final stage during the next few hours. The news is already causing protests on Twitter, where users are calling for a repeat of last year’s demonstrations.

      A Democracy is only a silent Dictatorship where the people have been brainwashed completely. What democratic country gives a damn about what the people actually think? The majority are slaves to their own governments ideals, afraid to lose what ‘privileges’ they have. A sense of freedom is a better alternative to a gulag, still, prison sentences (or the threat of them) is usually enough to deter the mass population from decent.

        Freedom’s only an illusion to the dim witted. In America Obama is trying to spend and tax his way out of a recession, so the People went to the polls and kicked out some 60 members of the Democratic Party (the biggest shift in the House ever, I believe) for being irresponsible with the People’s money. The only reason Republicans didn’t take the Senate is because most of the Democratic Senators were not up for re-election. Expect another huge shift in 2012. When Republicans won the House, they won the governments’ ‘wallet’. Even now they’re tapping the brakes on spending – all because FREE people went to the polls and voted!

        Freedom isn’t some idealized Utopian term where we all run around naked, free, and oblivious in a sunny field of soft grass — it’s something you have to actively and consciously pursue. And in order to be free, you have to take advantage of and protect your freedoms – not just let it wash over you like a warm blanket (that you feel you’re entitled to – you’re not). Oh, and actually VOTE. Voting makes all the difference.

        Progressives in America want to limit freedom in exchange for governmental power. If you want to at least keep what freedoms you have, vote against the Progressive Party. Remember, Hitler and madmen throughout the ages wanted Socialism (a goal of Progressives) because it was the easiest way to control a population. As history has shown time an again – it works! But it’s no mystery. We understand it just fine – educating the rest of the world is hard, however, once Socialism takes root. So, just say NO to radical Progressivism. Vote Democrat if you want, but be smart enough to know what issues Progressives attach themselves to, and why. Unfortunately at the moment the Democratic Party in America is run by Progressive extremists whose “ends justify the means.” If you’re not frightened by this, you should be.

This is true even for objectivist / economic libertarians, insofar as negative externalities are thrust upon the larger population in general at the expense of the few. It’s certainly true among the more fundamentalist fringe of the Republican party. Please stop assuming people whose values differ from your own are evil, just on the basis of a small but vocal minority.

          America is a right-center country, and has been for some time now. It’s not ideal in my opinion, but we haven’t gone to Hades in a handbasket either. Meanwhile, there are also plenty of left-center countries which are doing just fine without having turned into fascist socialist (whatever the heck that means) dictatorships where kittens are roasted alive and baby heads stuck on pikes.

Standing up for your freedoms is dangerous, and only a few people have the courage to do it – if the silent majority can not be persuaded to follow them, whether its fear or indoctrination, no amount of righteousness will make a difference. That’s why the most cohesive societies are ones in which the “majority” just goes with what ever is most scary to oppose.

          You’re right, I shouldn’t have used the word “Democracy”. By definition, there are no pure democracies in existence. Most of the time, the government’s decisions do not align with mine, but they are so disconnected from us that it doesn’t really matter. Sure, taxes affect how much money we keep, but no one controls what we do with it. Step outside, get in nature and tell me how strong government influence is. We are a species on this planet, no more, no less. People tend to focus on how government influences their lives, while taking for granted how amazing it is to say, travel 1,000+ miles in a day or share information with someone through a wireless device across the globe. Quit bitching and live a little.

          Also, I am very aware of special interests and what they do to our planet and the livelihood of all people. The way most governments are set up however, we have little to no influence unless we join a lobby or take office. Totally sucks, I know.

        It isn’t just an illusion. Freedom is a feeling. It makes your shoulders feel lighter, you mind able to be at ease, and your heart beat more freely. I live in California, with an overbearing government (not as bad as NZ though), but I’m still able to do pretty much anything I want shy of drunk driving (man I wish I could drive drunk sometimes…;). I truly feel like a free man, or at least pretty close to it. I have spent time in the 3rd world, especially Mexico more recently, and there are a lot of places you can’t go and things you cannot do because it is simply not safe.

        What I’m saying is that its not perfect (democracy) but its the best thing I’ve tried when it comes to freedom.

    i wonder who in the New Zealand government has been given the biggest ‘brown envelope’ by the entertainment industries to get this into law? it is obvious why this is being rushed through. the government didn’t want any opposition to the bill. if they haven’t informed all the politicians, what chance was there that the public would know? just as elsewhere, this government is totally ignoring the fact that they are elected by the people, to act for the people, not just for big business. i still dont understand why the world’s governments are not forcing the entertainment industries to join the 21st century with new business models, instead of changing laws to allow them to remain in the dark ages, and continuously penalizing the public, the customers, at the same time. why favour these particular industries over all others? why keep trying to hand complete control of the internet over to one section of industry?

      With thanks to the publishing of WikiLeaks’ USA cable communications a few months ago we know that many Country’s worldwide have been “diplomatically threatened” with severe trade sanctions by the Office of the US Trade Representative if that Country fails to implement new laws to protect so-called copyright infringement.

      The USA government is doing this to protect the movie and music etc industry in Hollywood who have paid US politicians billions of dollars to pass such laws.

      But WE filesharers run the internet and WE will act in defiance of such outdated, stupid attempts to smother true competition which are in reality holding back human development overall.

      I know how you feel, I am an American, and I know this “Copyright control” disease has spread out from our borders. The entertainment industry here has the most to gain from this kind of control. Once they eliminate the competition (from file sharing) they will be able to gouge everyone on the whole planet for their stuff, and fill it with advertising that nobody even wants. Our leaders are selling us out also, and their reputation worldwide is growing worse by the day.

    Er wasn’t this bill first brought in when Labour was in government? I remember looking at the first drafts and what it would mean for the provider I worked for at the time. One of the top tech guys said he could not confidently stand by the accuracy IP information they would be required to supply.

      Was my second thought as soon as I saw this bill being passed in NZ (first were those similar to Violated0′s post above giving a detailed answer to “why it simply won’t work”).

      Once again I am left with disappointment as another Government has put the $ of corporations over the freedoms of a countries citizens (right to use the net unmolested, presumption of innocence until proven guilty, etc.).

    Latest news does reveal that USA goverment have pressured and threaten New Zealand Government months to add 3 strikes-style legislation. Not big suprise is also that USA deadline day was 13/04/2011 to last day that New Zealand had to add new law. Whole law is USA written law and behind scenes USA do pressure all countries goverments to add new copuright laws. There are many other cases Spain, Sweden and many other countries. That guy who called those countries USA puppet states is totally right.

    The most distressing thing about this affair is the way the national government pushed the legislation thru; via the emergency powers given to it via the christchurch earthquake troubles, it should show you how rotten our national government is.
    Dont forget: The national government is exactly like the democrats in the US, they would sell their own mothers’ if they thought it would make a dollar…

    Am i living in a different New Zealand or something?
    It doesnt matter this is coming in, we have 2 strikes anyway. Take it to court and say your wireless was hacked, no wireless network is 100% secure. Will judges even understand the concept?
    Who is even policing this? I doubt they have the resources and if more money is spent on anything but ChCh then people will get angry.

      Why wouldn’t they. There is NO provision in this law to apply any sanction against mischievous citing of “illegal downloading”. I watched the live debate on their TV channel. For the most part the MPs showed themselves as bumbling baffoons, with no appreciation of what they were doing. It was thoroughly embarrassing. I now question the ability of those individuals to make any Law on any subject whatsoever.
