RapidShare Scores Another Win Against Movie Studio

RapidShare takes all reasonable measures to prevent movies from being distributed through its web-service, a German court ruled yesterday. The Higher Regional Court of Düsseldorf overturned the earlier decision of a local district court in a second case brought by movie outfit Capelight Pictures.

rapidshareLike most file-hosting services, RapidShare hosts a wide range of movies, music and software files that are distributed without the consent of the rightsholders. This situation has caused the company to be dragged to court on multiple occasions, but the file-hoster has come out the winner several times already.

In May this year, the United States District Court of California ruled that RapidShare is not guilty of copyright infringement. In a hearing closer to home for the Swiss company, a German court ruled in the same month that RapidShare cannot be held not liable for acts of copyright infringement committed by its users.

In a related case in Germany against the movie studio Capelight Pictures, RapidShare has booked another success after a lower court initially ruled against the file-hoster last year. RapidShare successfully appealed against a preliminary injunction granted by the Düsseldorf Regional Court, and the Higher Regional Court of Düsseldorf has now reversed the decision.

The dispute between Capelight Pictures and the file-hoster dealt with the question of whether RapidShare had undertaken all reasonable measures to counter the illegal distribution of one of the films owned by the movie outfit in Germany. While the lower court ruled RapidShare did not, the Higher Regional Court of Düsseldorf overturned this decision.

“The ruling is a further step in the right direction,” sad RapidShare lawyer Daniel Raimer. “The previously common practice of copyright holders [suing] RapidShare on the off-chance there might be something to be gained from it, misunderstanding the realities it is operating within and showing contempt for its business model, will no longer bear fruit. The newest court rulings in Germany and the USA indicate this very clearly.“

Christian Schmid, founder and CEO of RapidShare, commented: “We are also pleased with the ruling because it is connected to a claim for compensation of costs. Copyright holders should therefore think very carefully in future about whether they wouldn’t prefer to save themselves some time and above all the expense of suing RapidShare for something for which the company cannot be held liable.“

Together with the positive outcomes from the other court cases this year, RapidShare has less to worry about on the legal front in the future. The verdicts are undoubtedly a major victory for RapidShare, and they will also reflect positively on other file-hosters and even torrent sites. In fact, many of the arguments used by the Court also hold for the average torrent site, as long as they stay away from other means of facilitating copyright infringement.

    I don’t know why anti piracy is wasting their money and time with RapidShare :P

    If RapidShare goes down, what will happen to other 55 services which is similar to RapidShare ?

    this tactic won’t work. find a good way to shut down whole sharing system, one by one is not possible and this game will never end if you continue to crack down one by one.

    Find the root and shut down all at once if you can else don’t bother yourself !!!

    So the torrent sites that distribute torrent files FOR FREE get taken down and lose in court, yet Rapidshare, which CHARGES MONEY FOR ACCESS TO COPYRIGHTED MATERIAL gets away with profiting off of said material.

    I don’t quite understand how they keep winning in court. Something very fishy about Rapidshare…..

    Rapidshare remove copyrighted files as soon as the copyright holder complains. They also put up a filter that stops the same file from being uploaded again.

    The courts are agreeing that Rapidshare can’t do much more than that to prevent piracy.

    even if they NOW remove files as quickly as they can, they spent YEARS selling access to pirated materials that they hosted on their servers. Sites like Rapidshare are the problem in regards to file sharing, as they are the ones profiting from it, whereas torrent sites share for free.

    Exactly because they profit from it they can pay for better layers.
    Still the court’s ruling is correct, they do everything to remove such material when brought to their attention and so can’t be blamed.
    That’s a great precedent.

    I don’t care about file sharing sites like RapidShare, it’s often for a monthly or annual fee and it’s almost no different from torrenting.

    Yeah, because Rapidshare and torrent sites operate the same type of system.

    For a start, Rapidshare has file name/md5 has checking, whereas torrent sites don’t.

    Please, before posting such crap, do research.

    #14 I know what Rapidshare is and I know it isn’t exactly the same, I was referring to the file sharing itself, in the end you have the file and didn’t have to pay for it. I personally think it’s even easier to find something on a torrent site.

    Obviously RS isn’t doing all they could to reduce piracy. Repeat infringers could have IP blocked.

    Criminals are allowed to stay on the site because they make rapidshare owner millions, when the Scene doesn’t make a thing.

    The German courts are a joke.

    Ip block will do nothing to stop anyone from uploading to RS. For one, it’s easy to bypass by using a proxy server. Another thing, if it’s a dynamically assigned IP then when the shuffle comes around the person uploading gets a clean IP and some innocent person gets banned from RS for doing nothing at all.

    RS actually charge for unresricted downloads/speed but torrent sites give the same speed to all for free. admittedly, on some torrent sites, donations (not a definitive charge) can remove any waiting time before files can be downloaded.
    therefore, RS is DEFINITELY profiting from file sharing (premium account fees) but SOME torrent sites are only POSSIBLY profiting from sharing (via donations). makes me think there has to be more to why RS are getting away with things than simply their ‘take down’ proceedure.

    Then I wonder why bittorrent sites & search-engines can be held responsible for their users copyright infringement ? Hosting links is all that either part is doing.

    rs differs in that you can’t search for content. where as most torrent sizes list files into sections like screeners tv etc to download.

    RS also an official company pays taxes and owners are known. which can’t be said about most torrent sites.

    @10, TPB removed torrents that were reported… and they banned their info hash so it couldn’t be uploaded again. And probably this was done by a lot of other sited. Yet they were held liable.

    I have been using Rapidshare for some time and I have to disagree with many of the comments that have been said. Rapidshare are a compnay which care for their users and always keep you up to date on new services. Yes torrentz may be free but you wait for longer. On average a torrent download can be anything from 0.9kbps – 19kbps during peak time and only 7.2kbps – 32.9kbps during times when servers are not busy. Rapidshare offer a free service and also a premium service depending on what type of user you are. Free users have to wait around 14 minutes between each download but this is to prevent traffic sharing rising to a high. Rapidshare only charge to give you the best service possible. The profits which many people seem to believe are to provide its users with better speeds and to upgrade their servers. Without people paying there way Rapidshare and other sites will simply not exist as servers will become congested and speed will become much slower. Yes Rapidshare do profit some of the money from its premium users but don’t all companys make some profit? Many of you have argued that Rapidshare should be closed down due to piracy laws, however at the same time you stated that you prefer to use torrentz. It has been proved that only 0.3% 0f files via torrent downloads are legal and torrentz are not checked against piracy and other copyright laws. Rapidshare on the other hand do there very best to prevent illegal downloading which is much more than the providers of torrentz. Rapidshare are committed to keeping there service open and there is always the option of free downloading. I would be very interested in how many of you use Rapidshare and wether you disagree or agree with me. All opinions are acceptable and will be taken seriously. Thank you.

    I personally don’t like RS but this sets a good precedent.

    And the irony, MAFIAA tasting some of its “endless appealing” medicine from one that actually has the financial muscle to endure it.

    There’ll be a time when MAFIAA will be left with no place to run but evolution or death. We’ll live to see this. And laugh.
