US Government Responds To Domain Seizures, Ignores The Big Question

The Department of Justice (DOJ) and Immigration and Customs Enforcement (ICE) have just confirmed the seizure of 82 domains as part of Operation in Our Sites 2. The authorities claim the actions were targeted at websites that were involved in the illegal sale and distribution of counterfeit and copyrighted goods, but fail to explain why a BitTorrent meta-search engine was included.

Last Thursday we reported on the seizure of the music linking site RapGodFathers. As it turned out this was the first target in a growing list of domains that were seized in the days that followed, including the BitTorrent meta-search engine Torrent-Finder.

All this time the authorities remained silent on the purpose and scope of the actions, until today. Apparently the DOJ and ICE had picked the label “Cyber Monday Crackdown” for their actions, and this meant that they couldn’t release their statement earlier.

However, today a press release was finally issued, detailing which sites were targeted and why.

“As of today – what is known as ‘Cyber Monday’ and billed as the busiest online shopping day of the year – anyone attempting to access one of these websites using its domain name will no longer be able to make a purchase. Instead, these online shoppers will find a banner notifying them that the website’s domain name has been seized by federal authorities,” it was announced.

“The coordinated federal law enforcement operation targeted online retailers of a diverse array of counterfeit goods, including sports equipment, shoes, handbags, athletic apparel and sunglasses as well as illegal copies of copyrighted DVD boxed sets, music and software.”

“By seizing these domain names, we have disrupted the sale of thousands of counterfeit items, while also cutting off funds to those willing to exploit the ingenuity of others for their own personal gain,” said Attorney General Holder in a subsequent press release.

Since 95% of the domains were related to counterfeit goods, this explanation was kind of expected, but one question remains unanswered. In fact, this is the question that prompted so many news outlets to pick up the story over the last few days.

Those who took a careful look at the list of seized domains will have noticed that there are some odd entries. Among the replica watches and fake sport shirts are three sites that were directly or indirectly linking to music. That’s not counterfeiting, although releasing music before it hits the stores is a criminal act so these targets can be explained.

But there’s an even stranger entry, and that is Torrent-Finder.

Torrent-Finder is not a typical torrent site where one can download torrent files. It’s merely a meta-search engine that redirects users to other sites. The site simply displays a search box and has no browsable archive. The site is not encouraging or even facilitating copyright infringement any more than other search engines such as Google.

So the question that we’d like to see answered is what the grounds were to seize Torrent-Finder? Could it have been a mistake? Or perhaps a test?

If the US authorities were to target BitTorrent sites then Torrent-Finder is arguably the least likely target. Still, the owner lost its domain without even receiving a notice. That doesn’t seen right somehow.

If it’s so easy for the US Government to obtain a seizure order for a website that is simply a meta-search engine, and not by any means involved in linking to or hosting copyrighted material, then where does it stop?

Meanwhile, TorrentFreak has been made aware of (many) additional domains that are on a Government seizure list. More info on this is expected to trickle in later in the week and might reveal more about the future direction of Operation In Our Sites 2 after “Cyber Monday Crackdown.”

    most big leaks come from RRT Forums- the source for most downloads – over a million members all collectiong just new hip hop –
    they can never be closed – but they go after small time rap blogs made by potheads

    After looking around at Torrent-Finders website, The only thing that could possibly have anything the government would go at is the Forums. Torrent-Finder.com has a forum where users could possibly post links, This would give them the same grounds to seize as some other websites on the list. Albeit still a horrible reason, but the same none the less. I don’t understand why they wouldn’t issue those users banned if that was the reason.

    Not really. If im not mistaken, torrent finder only searches on major torrent sites like the pirate bay and kickass torrents who have 99% illegal, torrents for copyrighted material. This helps someone find copyrighted content much more effectively than google could ever hope top. Google can’t search dozens of sites at the same time. Essentially what torrent finder does was searching through dozens of online warehouses full of illegal content. The only possible way it could be used (or atleast 95% of the time) is for illegal means. Come on, let’s face it. How many people use torrents for non copyrighted things? Compare the traffic on a legal torrent site to one like TPB which has over 20 million users.

    People always say “well google should be illegal too.” Google isn’t geared specifically towards finding torrent files nor does it only search on sites who’s only purposes is to serve up intellectual property like it’s candy.

    Using OpenDNS or Telecomix won’t work. The nameservers responsibile for .com are sending you crap. It’s not cache poisoning or some filter at the ISPs.

    I see a lot of comments from anti-pirates here, and corporate shills. Since a number of you are sitting behind your computers with big smiles on your faces and cheering “VICTORY!”, I want to take a moment to make a few things clear to you.

    Before big media decided to use the internet, and before the term “anti-pirate” was ever dreamed of, huge numbers of geeks and nerds were sitting in their basements day after day and night after night, while the internet was in its most primative of forms. They were setting up base camp and meeting others like them, sharing ideas, and forming bonds, way back into the 80s and before, literally. Ask yourself this, were you even born at that time? You don’t even have the slightest idea of how long this scenario has been taking root, the sharing, the friendship, the community, even when I put it in terms of three decades. Just becuase you can’t “see” something does not mean nothing is there. Do not underestimate this simple fact when it comes to the internet community. Can you even begin to fathom the number of man hours that have gone into creating the “pirate networks” as they exist today during this time frame? Can you even wrap your head around just how many people are involved in these operations, who they have connected with, and what they have learned from them in over 30+ years? You think because you employ a “special branch of the US government” that it’s all suddenly going to come to an end as a result? The internet is big, very big. There are many places to hide via many different protocols. Do you really want this war? I don’t think you do, I think you just want to push pirates out of “legitimate web space” to make room for big media. I say, so be it, have your legitimate web space, but remember one thing – we’re still here, and we’re still not buying your products. Actions like seizing domains solidify that. We are sick of the lawyer games, you know the ones I mean, suing people for millions of dollars simply just to “make statements to the public about file sharing”, sick of hearing about the greed, the lies, the manipulation of goverment officials via campaign donations, etc. When I see these articles I share more. An internet free of pirates and everyone paying .99 cents for a song, when artists still keep only 2, 3 cents? If you think that’s going to keep working, you need to have your head checked.

    Remember everyone, the great secret to American stability is money, cold hard cash. Take it away and they’ll fight violently stopping at no end to ensure the stream of cash continues to flow, at ALL costs. Do you part, stop purchasing products from big media, and show them we can be just as inhumane as they can be – pirate and share EVERYTHING these companies have to offer, don’t stop! I think we can all agree, these guys are out of control and need to be taken down a few notches. We have the power to do just that.

    So, to all the anti-pirates and corporate shills, I think I just helped put things more into perspective for you. Now you know how things really are, and how a LOT of people feel about the subject. Welcome to the reality of online piracy and the internet in the 21st century – you have a LOT of ground to catch up on, and the pirate community will be doing *everything they can* to make sure to slow you down *as much as possible*.     Youtube and other video host has the right to have almost all music and clips for free there , lower rated sites are sized , this is a bull of shit .     I am really interested to see how this is all going to play out, I used to work for an internet company and I don’t see how what the government can call what they are doing “legal” either from a legal or a moral standpoint, it’s just wrong.     @44 telecomix dns will work. Only the updating part is not yet finished. As a response to this censorship one can not expect it to be fully operational the next day. And the ip’s have to be manually searched for or asked for to the owners ect.

    Furthermore the US has just proven itself to be worse than China when it comes to censorship. China at least only block sites where they have jurisdiction.

    They also fail to grasp the fact that they encourage the development of a non censurable DNS, darknets, i2p ect. Where they will have no say over ever again and where anonymity is absolute.

    That’s funny. I had the Firefox torrent finder toolbar addon for a few years (hardly ever used it though) and yesterday I went to use it and all that came up was the domain seizure notice from homeland security/ice. So I then went to https://addons.mozilla.org/en-US/firefox/addon/2755/ to see if there was an updated version of the toolbar.

    It states on the description of the addon “****** Domain http://www.torrent-finder.com has been changed to http://www.torrent-finder.info , next version will have that change”

    Also I read some of the user reviews https://addons.mozilla.org/en-US/firefox/addon/2755/reviews/ on the page and it seems (although I’ve never seen it) that the torrent finder toolbar addon for Firefox had malicious stuff in it.
    I went to torrent-finder.info out of curiosity and that domain has not been seized.

    ALL DOMAINS ARE ADMINISTERED TO COMPANIES LIKE VERISIGN, GODADDY & EVEN ISP’S BY ICANN.

    ICANN ARE IN CONTROL OF EVERY DOMAIN & EVERY IP WORLDWIDE SO JUST COZ DOMAIN IS SEIZED DOESN’T MEAN YOU CAN USE THE IP.

    ICANN is based in America & therefore subject to american law & legislation.

    Be ready coz this sh*t storm is barely a breeze yet.

    Basically the point is were in multiple dragging, costly, probably unnecessary wars, the borders covered in drug murders, the environment is getting worse, our education system is appalling, there’s a pretty bad unemployment situation out there, etc. And this is what they’re doing with DHS? But digital distribution has been shown to work so MAFIAA needs to stop obstructing progress. I mean they tried to prevent the mp3 player from existing.     I live in America and regret I wanted Obama in office [glad I'm not old enough to vote].
    Bush wasn’t good either, he signed a bill in that allows the Gov’t to wiretap without a search warrant.
    But Europe also is just about as bad as America when it comes to pirating/p2p, seeing as though all [if not, most] their ISPs monitor them and prevent seeding, or catch them in the act.
    Pretty soon though America is gonna be that way, and one day VPNs wont even be able to protect you.

    Oh wait, it is different. Google is the best damn search engine for illegally obtaining copyrighted material in the entire world, far better than TPB and kickass torrents because it searches all torrent sites, rapidshare, megaupload, etc.

    It doesn’t matter one bit what Google is “geared towards”. Bittorrent isn’t geared towards copyright infringement – it’s just a file transfer protocol. Torrent sites aren’t geared towards copyright infringement – they’re just a big catalog of whatever people decide to share.

    What matters is that Bittorrent, torrent sites, and Google are all used for the purpose of mass copyright infringement. Google being the biggest culprit by far. It isn’t important whether or not they can be used for other things too.

    You can’t sell Bibles and drugs, then when the police catch you, defend yourself by saying you were geared towards selling Bibles so you really shouldn’t be arrested for the whole drugdealer thing.

    Google is every bit as guilty as Torrent Finder. Of the same things, on the same grounds. But you don’t want people to realize that, because if enough people realize that, it might lead to a showdown betweent the Google and the MAFIAA. Which is a battle the MAFIAA would very likely lose, which would in turn set a precedent that torrent indexes and linked to copyright infringing material is legal.

    This is fundamental. If ICANN has done this, that means it can no longer be in USA hands to stay neutral.

    Nobody would really miss them.

    To see there is one torrent search engine in the list just makes me wonder if it’s not another desperate attempt from the government to prove file sharing is counterfeiting.

    Average non-computer savvy people opinion:
    “Look !!! They sell fake handbags and scarves AND they give torrents !. Torrents are criminal stuff too!!!”
    Sorry for the shortcut, but this is what this kind of communication makes me see.

    The “ICANN vs. VeriSign – who is to blame” debate is useless. They both cooperated with DHS whithout any resistance. One of the non-VeriSign managed domains: thepiratecity.org is also registry-locked by Afilias, probably because of the pressure from ICANN regarding faulty whois info.

    Right now, here are some precautions you should take if you are hosting a torrent/linking portal:

    a) DO NOT use .com/.net/.tv/.cc/.us or any other tld which has a US based registry, unless you have resources to fight in the US courts.
    b) If you use gtlds with non-US based registries, (like .org/.info/.biz/etc) – supply correct whois information and do not use whois guard/whois protection services.
    c) DO NOT use any US-based registrar. If you register .info at godaddy/enom – DHS will steal it from you at the registrar level.

    So the best solution right now is to use some cctld zone. For example, guys from torrentz.com registered torrentz.me on 27-Nov-2010, and now offer it as an alternative domain to access their portal.

    Lol, just kidding. Exactly. The people just went and got it illegally elsewhere and turned real criminals into people with power (Al Capone, anyone?). And even with all the busts and seizures and arrests they still ended up repealing the law.

    Perhaps this is history’s way of repeating itself. But instead of booze it’s not electronic information. And I’m just gonna say that. I hate the people who focus on only one thing. Half the sites I’ve seen focusing on this have people going on and on and on and on about illegal downloading, when there’s only one torrent meta-search site on the list of seized sites. It’s all counterfeit goods. But no one wants to focus on that because it doesn’t suit their need to troll.

    Come what may, the people will still do whatever they want to do. Drugs are illegal, people still use them and depending where you live a dime of anything can literally cost you ten bucks. Assaulting someone is illegal, but there’s plenty of fights and murders around the country almost on a daily basis. So eh. I’m not gonna worry too much.

    And since “F*ck The People” by The Kills just came on in my media player, I must bid you all adieu. This song’s too fun to not enjoy. And the funnest part? When it says “Hey, f*ck the people!”

    I think what happened is wrong. And I think the same, if they shut down a torrent site, then the same should apply to google or any other meta-search engine. Because results for torrents can be found just about anywhere.

    But yeah, like I said, I meant towards the trolls. The ones who are happy about all this. Without realizing that when someone has the power to shut down one site at will, they have the power to do the same to any others that they do not approve of.

    How does modifying the hosts file help the browser resolve to where tvshack.cc is actually hosted?

    ALso, is there a list somewhere of domains that are not under control of ICANN? I get that .com domains are all US controlled as well as others that they might manage for other countries. I also get the point that avoiding a US host for sites is a smart move, but is there a list of the types of domains that are definitely not response to US threats. Increasingly, it needs to not just be US domains/hosts to avoid, but also other countries (with BREIN and others) that also are not ideal.

    To the people angry with America, please make the distinction between our assclown government and the regular ordinary people who want to use these torrent sites just as much as everyone else in the world. We had no say in this and are just as infuriated by it as the rest of you. We are NOT all flag waving ignorant assholes who stand by every action our government makes. I’m pretty sure that other countries will watch the progress of operations like this to see if they are a viable option, If so, you can be sure your countries will start seizing domains too.

    Ok so everyone knows lemmings are not real creatures i assume, well not the ones represented in that old nature video from Ireland or whatever. do i even need to add the insulting parts after that sentence , no i dont think so anyone who has a IQ over 90 would be able to read the subtext. on another note the seizures were expected , anyone who has been sharing files for any reasonable amount of time would know , every year for the past 11 years , napster being first , have been shutdown and seized this time of year, its a game the american government plays. the question you people have to ask yourselves and your family and friends is “who does our law enforcement work for”. your country has been taken over by a hostile force called Nazis. its just a simple fact that your country harbored over 10,000 nazis in the early 1900′s. these people have multiplied like rats and you have lost your independence. you traded your former english “oppressors” for jewish ones , Israel. now i wanna know what exactly you guys plan to do about it , i believe you will do nothing. the proof of this is the Tea Baggers . if this is what your revolution looks like , well ive seen scarier revolutions in public schools …..

    Google is making it clear that it is going to be more aggressive re: copyright infringement.

    The Australian Federal Police and the American Government dropped their complaints against Google recently despite the fact that Google were found to be in breach of the Telecommunications Interception Act.

    ..We all know that Google can be used to find infringing material just as can Torrentfinder except on a larger scale.

    Wonder what is happening.
