New Megaupload To Launch On Police Raid Anniversary

January this year the U.S. Government destroyed Megaupload, but founder Kim Dotcom is a not done with the file-hosting business yet and is preparing a comeback with something bigger and better. Over the past months a group of coders have been working hard on the new “Mega” venture and Dotcom announced today that the raid-proof service will launch exactly one year after Megaupload was shut down.

megauploadWith 50 million visitors per day at its peak, Megaupload was one of the largest websites on the Internet.

This abruptly ended January this year when the U.S. Government took down the file-hosting service and had several key employees arrested including founder Kim Dotcom.

Despite ongoing criminal proceedings Dotcom and his team are determined to launch a new Megaupload, which will simply be called “Mega”.

Initially the new Mega was expected to launch in 2012, but according to the latest information the launch is now scheduled for January 19 2013, exactly one year after Megaupload was shut down.

“The new Mega will launch exactly 1 year after the raid,” Dotcom announced a few hours ago, adding that there’s a Doomsday launch button in place, a reference to the device U.S. authorities claimed could have been in place to self-destruct the old Megaupload in the event of a raid.

Previously Dotcom said that the coding work for the new Megaupload was nearly finished and that the servers had been ordered. Investors are lining up to join the new venture that Dotcom has described as a “massive global network.”

“All non-US hosters will be able to connect servers & bandwidth,” he explained.

According to Dotcom we can expect a Mega with an even greater range of applications than just file-sharing. Developers of file managers are being encouraged to get in touch for early API access, and Dotcom is also calling out to those involved in email and fax tools, VOIP and video apps.

For users the new Mega will also mean more security. Uploaded files will be encrypted using the AES algorithm. Users will then be provided with a unique decryption key giving them sole responsibility for who can have future use of their files.

Former Megaupload users who expect “Mega” to give them access to their old files will be disappointed. While Megaupload is trying to convince the court to help users retrieve their old files, the new Mega is going to start from scratch.

One detail that still remains a secret is the domain name the new Mega will be operating on. Megaupload.com remains seized and is therefore unavailable.

Dotcom told TorrentFreak that he hasn’t made a definite choice for a domain yet. He did register a few options this summer that would be fitting for the new service, and his other upcoming project Megabox.

Whatever the choice turns out to be, January 19 is going to be an eventful date once again.

    Go Mega, aaaand first LOL

Jan 19 2013 will certainly be good enough for me as a start-up date – specially as it’s their 1st anniversary of being taken-down, raped and unlawfully seized by the authoritarian agencies of the United Corporate States of Fascist America.

That said, I still hold a sneaking wish to Santa that Mega would’ve been back up and running by Xmas 2012 as a terrific prezzie to all loyal fans who miss their fave site.

But fuck it, I’m willing to wait a coupla weeks – are you?

      • Guest

To be honest, I was hoping all along that Kim would launch Megaupload 2.0 (i.e. Mega) on the anniversary of the raid. Doing so is the second-biggest “F U” to the MAFIAA that I can imagine.

(The biggest one will come after the case against Megaupload collapses, as I’m sure the US and part of the NZ government are fully aware)

The thing about Jan 19th 2013 is that we first will have to survive 21st December 2012, which the Mayans said would be the end of the world or something like that, so……good luck to us all. :D

        • Guest

Well the end of the world occurred 4 or 6 years ago. And the celebration of the MIllennium should have been 4 or 6 years ago too. When the monk who worked out the calender calculated the years since the birth of Christ he was out by 4 or 6 years as he miscalculated due to not calculating the years of one of the Roman Emperors. Think i will go back to sleep now.

The DOJ are likely to end Kim’s world before that, and are threatening to sue him for breaching an explicit agreement to not start another similar type storage site while/before this case is heard.

It will be interesting to see how long the site stays up/Kim’s not sued again in January.

          Good luck to him though.

No, December 21st is not the end of the world, it’s the end of common sense.

The question remains if this service will offer premium (paid) option or if the files will expire (if not downloaded or if user makes a login) at the same period (usually 90 days) as the other services.

I knew a recent service which offered unlimited expiration time and for free, but sadly they limited the size of files (2 GB > 1 GB > 200 MB) and now no one can upload anything more than images and documents (RAR and similar are not allowed, the upload is cancelled if you try).

Megaupload had 90 days in their FAQs, but before it was busted, the expiration time for free accounts was announced as 2 years.

If this feature (unlimited expiration time) is paid, at least please don’t exploit us like Rapidshare and others are doing, their fees are very expensive.

‘Uploaded files will be encrypted using the AES algorithm. Users will then be provided with a unique decryption key giving them sole responsibility for who can have future use of their files.’

i am so looking forward to this ‘MegaPhoenix, rising from the ashes’. i am trying to figure out how anyone is going to know who to give the decryption keys to? what is to stop any arse hole from the entertainment industries etc from being given the keys under false pretences? surely that will put the new site back into the same bucket of shit the old one was in. forgive me for being dumb so an explanation would be welcome.

also, considering the threat that the US DoJ issued about Kim going against the terms of his bail and therefore being liable for arrest again until the extradition is sorted out (because there is no way, regardless of how many courts tell them to drop the case) are they going to let things go, how is he going to get around this threat? one thing i think would help is if he were to release, as he said previously that he would, the name(s) of those involved in authorizing the original raid! perhaps having their names ‘in lights’ all across the internet will make the USA government, politicians and entertainment industries slow down and re-think the roads they go down with no thought for others!

    • Anyone

each file has its own decryption key
if you want to share your file you have to share the link to the file and the decryption key

that key will give people only access to that file, not to every file that you uploaded

    • Qjo

While it is true that the “bad guys” may indeed gain access to keys for individual fies, KDC & CO. will now be able to claim plausible deniability as to the content being hosted on their servers.

    • http://profiles.google.com/zerianis10 Christopher Kidwell

Easy answer to that: Open a website/forum, say that MAFIAA people are not welcome and that if you enter the website you agree to not sue AND to not report anything on the website, problem solved.

      • http://twitter.com/krozareq krozareq

That doesn’t work. Their right to sue you is protected by law. You can’t overrule law with a disclaimer.

        • IMForeman

This is why you have a NDA signed upon entering the site, have it closed to public and you have to sign a NDA in order to access the hidden content.

        • http://twitter.com/krozareq krozareq

Still won’t work. NDAs do not protect an entity from law. Even waivers that you have to sign to do stuff like bungee jumping do not protect the company from negligence.

Do you really think the MAFIAA would allow some kind of loophole like this in the law?

      • PelouzeTF

          > “seriously, you think writing a few disclaimer lines exempts you from anything?

          > You sir, are a grade A moron.”

Funny comment when taking into account that it’s coming from the ignorant person who previously argued that people pay for a right when they purchase a CD, when consumer legislation is crystal clear regarding that consumers can only buy two things, goods or services, not rights, and that the only thing that happens when you buy a CD is the exchange of ownership of that good, nothing else. Have you learned since then, or are you still that ignorant?

  • Anon

Will mega be back on a .US domain then? :-P

    • 7th_Guest

I dunno, will the sheep dine with the wolves tonight?

  • Bakapinkuu

i’m glad, but isn’t it a bit premature to expect that KDC’s bail conditions (not resuming operation of Megaupload) will have been rescinded that soon? I know if I were the judge, I would be extremely unamused by this news, or by the argument that “But this is a NEW business with the same functions as Megaupload, not Megaupload”.

We’re all looking forward to your return, KDC… but please don’t do it at the expense of your freedom.

    • Guest

If the new business is started, operated and run by someone else and that Dotcom is not listed in the startup paperwork, not listed as a member of the company and not listed as an employee or employer of the company then there is nothing in law whatsoever to stop that person then signing over the company to Dotcom once the Megaupload has ended and finished. If this were to happen then any bail conditions about not running a business would not have been breached as Dotcom will not be running a company or a member of one if it is in the name of someone else and that someone else is running it.

      • lattari

That’s not true. First of all, giving legal custody of millions in assets to a ‘friend’ is a recipe for a future murder investigation. As for ‘buying’ valuable things in symbolic or nominal fees, its illegal in many places and constitutes fraud and possibly tax evasion.

    • http://profiles.google.com/zerianis10 Christopher Kidwell

Bakapinkuu, that bail condition was illegal on it’s face anyway. It’s like telling someone they cannot work for someone else while they are on bail for stealing or allegedly stealing.

It’s an unenforceable stipulation and Dotcom could challenge it in court if the judge tries to enforce it.

      • lattari

Once again I have a compulsive need to correct your fantasies. There are bail conditions that prohibit arbitrarily almost any type of thing, all of them legal, it’s the morality that’s in question. Some prohibit using devices (such as computers or phones), travelling or visiting parks, some force you to make phone calls to police every 6 hours, they certainly can ban you from starting a business.

      • Colincarr99

If I’ve got it right, it’s the US prosecutors in the US court telling the US district judge that KDC would be in breach of his NEW ZEALAND bail conditions. This looks like yet another attempt by the US authorities to meddle in another sovereign independent nation’s court proceedings.
Oh sorry, I forgot, we’re all supposed to be colonies the FSA* now.

DOJ was complaining that he’d zip off to a non-extradition country. Well, he didn’t do that. Nor has Mega suggested opening Megaupload again except to get people’s data back. The new business might be a “shade of grey” but it’s brighter than white when compared to all the illegality of the takedown.

First I am sure Mr. Dot Com has consulted with attorneys and covered the bases. What encryption does is make it much harder to take down files. I am not sure what tools are used to take down files at most hosters but hash tags are used so when files are taken down all files with identical hash tags are taken down. With encryption all files have a unique hash so files can only be taken down one at time.

The industry is lazy and does not want go to all sites where it might be posted and take down files one at time. That is one reason why encryption is great. Second the hoster can’t be held liable because all files are encrypted there is no way the hoster can know what is in the files and certainly doesn’t have the time or responsibility to surf net and ensure no copyrighted files are uploaded.

Finally as with this service the US has made sure that all hosting services will be driven overseas and completely out of their jurisdiction. You can be sure no server will be found on US soil. May be in Canada or somewhere in South America but not in the US even though no matter how the Government tries to twist definition I do not believe servers alone constitute a legal basis for jurisdiction.

Every country in the world ought to watch this case because the US government is pushing the courts to go through such gyrations with definitions that the judge is unwittingly going to grant the US government jurisdiction any where in the world where there is internet. In this case there is no way to serve megaupload a foreign company so the case must be dropped yet a judge has bent over backward to give the government time to figure out a way to serve the company. They want to extradite and serve Mr. Dot Com but how can you legally do this? How can you request extradition for an invalid case only to try and make it valid? Sorry for the off topic but I just can’t believe the miscarriage of justice here and how the judge is completely ignoring the rule of law and is attempting to rewrite us jurisdictional laws.

The sad thing is even if the case is dropped the government will continue to argue to keep the servers and megaupload offline. Those who lost data might as well move on because your government will fight for years to keep it from you and if you ever get it back it will be years and will be outdated and irrelevant by then. In the case of assets and money it will take years for them to be returned if they ever are. Just ask anyone who has had anything confiscated even if no crime was committed how long it took and how hard they had to fight to get their money and/or property back.

    • Guest

“Even if the service is encrypted, it wont stop Hollywood or the record labels from suing. And if a content owner who sues can prove that the site is used for piracy, the fact that it’s encrypted isn’t likely to be much help to Mega in court, according to Santa Clara University law professor Eric Goldman. He tells MediaPost that a federal appeals court ruled nine years ago that a service provider can’t avoid liability for users’ copyright infringement merely by encrypting files.

In that case, the 7th Circuit Court of Appeals upheld a ruling that shut down the peer-to-peer service Aimster. The company argued that it didn’t know whether users were infringing copyright with the service because the files were encrypted. But the federal appellate court ruled that Aimster’s encryption didn’t give the company a defense. “Willful blindness is knowledge, in copyright law (where indeed it may be enough that the defendant should have known of the direct infringement,” the judges wrote. “A service provider that would otherwise be a contributory infringer does not obtain immunity by using encryption to shield itself from actual knowledge of the unlawful purposes for which the service is being used.”

I am sure that the MAFFIA will sue the Mega for facilitating copyright infringement if they can show that the new Mega can be used to share copyright files. I do hope that Mega can win over the MAFFIA but i have this feeling that they will not be letting go.

      • http://profiles.google.com/zerianis10 Christopher Kidwell

The 7th Circuit Court? BWAHAHAHAHA! That court is KNOWN to be out of control on various issues.

        • Guest

Whatever people think of the verdict it will sure favour the DOJ in there quest.

      • Heisenberg7

It’s a good thing the servers will be far away from the jurisdiction of any appellate court in the U.S., then, isn’t it?

      • Colincarr99

Your arguments are all based on the new Mega being sued in the FSA. If NewMega has no staff, and no assets in the FSA, then suing them there is a bit pointless. As we’ve already seen, there is a problem with serving a writ…

        * FSA = Fascist States of America.

Think of it as the difference between the old and the new.

The old is huge, slow, organized, invulnerable, exclusive, privileged, coercive, private profit driven, and lucrative.

The new is small, fast, chaotic, vulnerable, inclusive, officially unsanctioned, voluntary, public spirited, and, most often, very hungry.

Did I mention, “Very, Very Hungry?”

Well, let me mention “Very, Very Hungry” again, because it’s that important. You see, the Old doesn’t become obsolete merely because of the passage of time; just as the New doesn’t get born in the midst of Kim DotCom or Jeff Bezos or Steve Jobs taking a dump merely because it’s 8:30 am on this fine Sunday morning. No Sir!

The Old becomes obsolete because in the passage of time it has allowed huge gaps to grow between what it promises and what it delivers; between what it thinks is its place in the world, and what that vast wide world knows it to be.

The New is born between those gaps, a rejected bastard orphan who owns only its Hunger; and, is willing to see the world in a wholly new light.

That the Copyright monopolies must call out the government to call out the Swatt Teams and Prosecutors, just tells us yet again how well fed and obsolete they really are.

I think it’s inevitable that’s right INEVITABLE that ALL of the U.S.A elites will be doing EVERYTHING they can to STOP MEGAUPLOAD. (they are absolutely psycho desperate absolutely!)

I do NOT believe that MU will be coming back again, KIM’s location is NZ he will CONTINUE to be RAPED by the NZ SLAVES OF US.

Even if MU does come back it will STILL be taken down somehow or get hacked somehow or fail to make money or VISA/MASTERCARD ALL payment processors will DENY MU just like WIKILEAKS.

THINK ABOUT IT. MU WONT come back. IT WONT.
THE NEGATIVE possibilities FAR OUT-weigh the positive.
    It’s TOO LATE!!!!

Megaupload WONT be back but MEGA will BE launched whether the DOJ and MAFFIA likes it or not but MEGA will BE launched.

    • Colincarr99

I’m sure the MAFIAA, Biden, Macbride et al will indeed do their damnedest to keep Megaupload down.
But to date the New Zealand courts have shown a refreshing degree of honesty and fairness in dealing with the ‘lapses’ of the NZ police and spooks.

It may take years, but ultimately this flagrant lawbreaking by FSA* and NZ authorities will only serve to weaken the FSA as an economic power and trading nation. After all, who wants to play ball with a big bully that never follows the rules?

      * FSA = Fascist States of America

It’s not immediately clear the DOJ has a strong legal case. Dotcom said in his affidavit that he COULDN’T relaunch Megauplaod at that point, not that he WOULDN’T

The prosecutor would have to prove that Dotcom intentionally mislead what he said with intending that he wouldn’t relaunch Megaupload either at the time or in the future and that would be very difficult for them to prove considering that he never actually stated that he wouldn’t relaunch Megaupload in the future.

Little by little we will take away all of the power that corrupt governments and corporations have given themselves over the Internet.
We will turn the Internet into what it should be; an Invincible network that exists amongst the people and remains fully functional and anonymous regardless of what these corrupt governments and corporations may want.

      Release the code monkeys!! :D

    • guest

IT won’t matter eventually all governments/companies will lose the power they have now over the net and the web will be a place to find anything and everything we want (minus a few subject matters that is banned in all countries CHILD PRON, etc,)

besides that eventualy people will be able to access the web with out a ISP I may not see it in my lifetime but it will happen.

WE the PEOPLE of the WORLD control WHAT IS AND ISN’T GOING TO BE PUT UP AND SHARED WITH EVERYONE.

Criminals fighting criminals on the behalf of criminals. Since I’ve been made poor by the fascists in the ruling class I take whatever I can and therefore make the playing field just a bit more level. When you take form a billion dollar corporation, it’s like stealing a grain of sand from a beach: no one notices, and no one cares, and the effect is nothing unless trillions of people take a grain. But there aren’t trillions of people.
