Iconic Piracy Suit Against Google Dismissed, Despite $25,000 Bounty

After 8 years the legal battle between Google and adult magazine publisher Perfect 10 has been put to rest. The latter accused the search giant of a variety of copyright infringement breaches which included Google’s use of cached images. In a final attempt to save the case, Perfect 10 offered a $25,000 bounty to anyone who could prove wrongdoing on Google’s part but the initiative failed. The case has now been dismissed without the option for further appeal.

perfectIn 2004 Google was sued by Perfect 10. The adult publisher demanded a permanent injunction against Google to prevent it from copying and distributing thumbnails of its images, and to stop the search engine from linking to websites where Perfect 10 content was hosted illegally. Initially Perfect 10 scored a substantial victory as the court agreed with the adult company’s position on Google’s use of thumbnails. However, the Ninth Circuit Court of Appeals later reversed this ruling stating that this utilization of thumbnails amounted to fair use. What followed was a lengthy legal battle in which the adult company targeted Google with a wide range of secondary liability claims. These claims were often supported by the MPAA and RIAA, and opposed by digital rights groups such as the EFF. After nearly 8 years of litigation and two failed requests for a Supreme Court review, the case continued at the District Court where both sides accused each other of breaking the rules. Notable is Perfect 10′s quite unconventional last-minute attempt to find more dirt on Google. Earlier this year the company called on the publicto provide evidence that Google was aiding or abetting copyright infringements. The publisher went as far as offering a $25,000 bounty, which is still listed on its website.

“Perfect 10 is offering $25,000 (twenty-five thousand dollars) to the person who provides us with the most compelling non-public evidence of Google illegal conduct between now and February 28, 2012.”

“The type of evidence we are looking for would be emails between a webmaster and Google, showing that Google aided or condoned copyright infringement, or that Google was involved in other illegal activities not known to the general public.”

However, judging from the recent court updates this offer didn’t bring in the much-desired evidence. Both parties agreed to dismiss the case with prejudice, meaning it can no longer be appealed. “Perfect 10 agrees not to commence any future lawsuit against Google in any court arising from any such Google act or omission on or before the date of dismissal of this action, or any such DMCA notices sent by Perfect 10 on or before the date of dismissal of this action,” the court filing reads. Whether the dismissal follows on an out-of-court settlement is unknown. A Google spokesperson didn’t answer this specific question, instead offering the following comment. “We always asserted that there was no merit to this case. Plaintiff seemed to agree: last week he asked for a dismissal of the case with prejudice.” Another plausible reason for the dismissal could be that Perfect 10 was feeling the heat, as the court ordered the company to open its books and provide full insight into all internal communications regarding the court case. While the dismissal marks the end of a landmark case, Perfect 10 shows no sign of slowing down their legal actions. The company has a long history of copyright cases targeting companies such as Megaupload, Amazon, and Hotfile. Last month Russia’s Google equivalent Yandex joined these ranks, and earlier this week Perfect 10 sued the microblogging platform Tumblr. And so it continues.

          Yeah, I know that Google’s business model is to spy on internet users and use the data they mine for advertising. That doesn’t really make it better, though.They treat privacy like it’s their enemy. They even created a Safari hack to bypass user privacy setting so they could keep mining detailed user data, even if the user set detailed data mining to OFF. Should they be forgiven shit like that because they do it in the name of making a buck? I think, no.

          Google’s +1 button cookies count as tracking. So do facebook like and share buttons.

          Google bypassed safari and IE’s ancient protocols (Circa 2002) to make their +1 buttons work on 3rd party websites.

          Since +1 buttons get roped in with “tracking” (it’s called tracking because when you +1 something, it is added to a record that is shown to other users that you publicly +1′d something and show you relevant ads based upon what you publicly like… that is the extent of it).

          Learn your facts before posting on the internet like a bleeding moron. Moreover, you might want to go so far as to get an inkling of how the web and web browsers work before going off half cocked about shit that is far beyond your pathetic IQ.

      Better for the courts to put the smackdown on these cases and summarily dismiss them unless there is some proof of wrongdoing from day one.

      There are a number of countersuit laws to that effect. As Christopher has it below though, implementing said laws without causing more harm than good is difficult or even impossible. It’s a bit like how you can’t enforce the copyright monopoly without also in effect maiming freedom of speech in general.

    If Google, instead of an out of court accomodation, had gotten in touch with its inner Corporate Hannibal Lecter, it could have given the litigating world an incentive worth remembering by turning Perfect 10 into the closest aproximation of a Perfect Zero.

    To put it in Human terms, “Google didn’t take it personal.”

    Could it be that what Human Beings consistently “take personal” is every single human value that can NOT be reduced to a quantitatively adjustable cost benefit calculus:  Things like “Freedom of Speech”, “Right to Privacy”, “Freedom of Association”, “Presumption of Innocence”, “Due Process”, “Self-Respect”, “Fair and Humane Treatment”, even “Love”. 
     
    This uniquely Corporate Talant is not just a matter of “neutrality” respecting these values. 
     
    A most cursury historical review persuades us that no human order in all of human history has EVER been based on “neutrality” regarding these fundamentally human values. 
     
    I think that the sneaking human suspicion that becomes persuasive in all of our hearts on deepest reflection is that this uniquely Corporate Talant represents, in fact, NEGATION of these human values; and, perhaps, their substitution by an evolutionarily adapted social order based on the efficient accretion of power uninhibited by the fundamental constraints of Human Purpose.  Again, to put it in Human terms, “Corporations don’t take “IT” personal. 
     
    In this regard, the ultimate Human Tragedy was the legislative grant of Corporate Standing which gave these Corporations all the Rights of Natural Persons (as human beings) to be present in the legislatures for the purpose of making law.  Only now are we beginning to realize that the resulting Law negates our most treasured Human values.

    Let us remember that Google has a DMCA take-down process to remove links to infringing media which Perfect 10 could have used as much as they want. So they were only blaming Google for their own lack of action.

    No surprise at all that they failed. This though is only one battle in a major War that will shape the nature of the Internet for our children and grandchildren. Perfect 10′s loss today is a victory for their freedom.

      Usually because since the profession arose the use of a lawyer has mainly been  in order to sideline both common sense and the spirit of law in favor of one party or other. Something which dates all the way back to Roman days.

      Somehow when I read about “Perfect 10″ another company name surfaces – “SCO”.

      There are many good things and many horrendously wrong things with the US system. One of the worst parts is where it allows litigation to turn into a business model with so little effort.

      Generally speaking, if perfect 10 had won the sky would have been the limit on the return of investment. As is they lose their investment but aren’t held accountable for what amounts to a legal extortion attempt.

      It’s hardly new though. The US has attempted tort reform for decades and unfortunately the strongest lobby of all is today that which consists of tens of thousands of highly paid lawyers with good connections who all want the system to remain just as it is…

    sorry for being thick here and i am sure someone will quickly correct me, is it now legal for Google to ‘link to websites where Perfect 10 content was hosted illegally’, but not to websites that could host other illegal content? is it still illegal for other websites to link to yet other websites that could host illegal content? what if a website doesn’t host anything at all but links to other websites that could contain illegal content? there needs to be total clarity here. ordinary people are being extradited to the USA because of linking to sites that may have contained illegal content, but a giant company, the biggest internet search engine in existence no less, is allowed to do so. either linking to websites hosting/containing illegal content is legal or it isn’t. cant be one thing because your a massive company and the other because you are an individual with no money to defend yourself!

    I don’t understand what Perfect 10s gripe was in the first place. Google had links to images in their cache directing searches (and thus traffic and potential revenue) to their site. So why would they want to stop Google sending new customers their way?

    It’s almost as weird as the MAFIAA continually attacking and suing the entertainment companies’ best customers. None of these tactics make good business sense.

    The problem with lawsuits is that it costs hundreds of thousands in legal fees whether or not any resolution occurs.  These people know this.  It costs a lot less to prosecute then it does to defend.  It’s simply a fact.  You can “cry wolf” and cost the other company a bundle for no good reason.  The justice system needs to recognize this and correct it.
