The place where breaking news, BitTorrent and copyright collide

Police Raid Russia’s Largest Porn BitTorrent Site

In 2010, Russian authorities seized the domain of the country’s biggest BitTorrent tracker, Torrents.ru, in copyright related action. Now, just over a year later, police have swooped on its sister site, Pornolab – Russia’s biggest porn tracker – and seized its servers. With the recent demise of two other huge adult trackers, it’s possible that Pornolab was the largest adult torrent site in the world.

pornolabFor many years, when BitTorrent sites around Western Europe and the United States suffered legal pressure and were forced to look for new homes, fingers have pointed to the east. Russia is not exactly considered a market leader when it comes to copyright-related enforcement and neither is its western neighbor, Ukraine.

In February 2010, however, an event occurred which rocked the boat. Citing copyright concerns, authorities seized the domain name of Torrents.ru, the country’s biggest tracker with millions of members.

The site continues today under a new domain, Rutracker.org, with its troubles seemingly behind it. The same cannot be said for its sister operation, the adult torrent site Pornolab.net.

Despite being Russia’s 93rd most popular site, Pornolab chose to operate out of a datacenter in Ukraine. The authorities there say it was a huge operation, serving 2 million registered users. With the recent demise of Empornium and PureTNA, this may mean it was the biggest porn tracker in the world. In the last 24 hours, however, all that came to an end.

According to police in the capital, Kiev, yesterday their officers swooped on the site’s datacenter and seized its servers. Unusually for a case of this type, the complaints that led to this action were not related to copyright infringement but to the unlawful distribution of pornography.

The police are citing contraventions of Part 2 of Article 301 of the Criminal Code of Ukraine which covers crimes against children using the Internet – in this case the importation, production, sale and distribution of pornographic material without age restriction.

In addition to attempting to bring the operators of the site to justice, the police say that they will also try to identify Ukrainian users of the site. Due to the nature of BitTorrent – downloaders automatically upload too – they too are being accused of the unlawful distribution of restricted material.

In the past, Article 301 has been used by the government to shut down various publications deemed to be offensive, including literature aimed at the gay community. Punishments can extend from large fines to 5 years in prison.

Ukraine is also home to Demonoid, one of the world’s largest BitTorrent trackers. Unlike Pornolab, Demonoid expressly forbids the tracking of any adult-related content. It also goes one step further, probably to ensure it stays the correct side of the Ukrainian authorities, by banning all local traffic. Pornolab did not and according to estimates, up to 700,000 of its members called Ukraine home.

This is not the first time Ukrainian police have shut down a an adult themed torrent site. In May 2010, xsweet.net.ua was targeted for the same reasons and its 35-year-old operator arrested.

Hate to agree with SherBalls on this one but if they were distributing the Pr0n without any kind of age restriction process in place (even if its just a Click to Enter style warning page) they’ve got them bang to rights – censorship has nothing to do with it.

Mind you I’ve no idea if they did have anything like the aforementioned in place as I never used it. Personally I think BT for fap purposes is a bit old-hat

It’s something that can be easily fixed, the no 18 yr-old check. In my country when some activity, business or not, has some setup problem that can be easily fixed it usually goes for a warning and sometimes a fine.

It seems to me that it is abuse of some law. Unless it is clearly written in the law that failing to comply with having a 18 yr-old check is a crime subject to jail sentences. Since I’m neither Russian nor expert in Russian law (and neither sherballs is) I will give the benefit of doubt. And ask for one of the Russian TF readers to clarify that for us.

On a side note, when did intermediate pages with “I’m under 18″ buttons that lead to Disney website prevent kids from getting their porn? But I can see why you have to have a warn page before throwing the porn at the surfer, kid or not.

    • http://www.facebook.com/eric.boehm Jack Murdock

Nice try there, sherlock. But not really. You see, it’s only censorship if the subject matter is legal. Plus, there needs to be some sort of expression. Clicking a “download .torrent” button hardly qualifies as speech. By that same logic, you could say that shutting down bootleggers is also censorship.

The pirates tactics of taking things to their logical extreme and comparing them with anything that is even remotely similar is pathetic. By your logic, we could also say that anyone who favors gun registration supports gun bans. And why stop there? I bet they are also in favor of the government banning other things and thus they support dictatorships. Using pirate logic, i’ve just proved that anyone who doesn’t condone giving completely unrestricted access to guns is secretly also wants a dictatorship!

By this line of thinking, you could easily conclude that any laws that forbid any sort of behavior are evidence of the government’s wish to enslave you. This is some of the worst logic ever.

      • Ninja

Misinformation and false propaganda is the worry. And yet I did do a half-baked job and didn’t say that we need further knowledge of the Russian law to dismiss these accusations. Russian Govt is not famous for being liberal and fair.

I will give you the benefit of doubt and I will assume you haven’t read the comments that followed my initial post. But I’ll also agree that it seems a flawed logic since I didn’t type down what I said in my last follow up: we need better understanding of Russian law, I made the assumption based on my country legislation so I CAN be wrong but I seriously DOUBT it.

Meanwhile, based on past Russian Govt antics I will assume it’s one lame attempt of justifying their extreme conduct (arresting the guy instead of giving the case a fair legal procedure).

      • Anonymous

“You see, it’s only censorship if the subject matter is legal. ”

        HAHAHAHAHAHAHAHAHAHAHA!

Okay, for people who don’t know, here’s a fact about Jack. He likes to make up his own definitions of words.

These are actual definitions of ‘censorship’ and ‘censor’, courtesy of the Random House Dictionary:

        cen·sor·ship? ?
        [sen-ser-ship]
        –noun
        1.
the act or practice of censoring.
        2.
the office or power of a censor.
        3.
the time during which a censor holds office.
        4.
the inhibiting and distorting activity of the Freudian censor.

        cen·sor? ?
        [sen-ser]
        –noun
        1.
an official who examines books, plays, news reports, motion pictures, radio and television programs, letters, cablegrams, etc., for the purpose of suppressing parts deemed objectionable on moral, political, military, or other grounds.
        2.
any person who supervises the manners or morality of others.
        3.
        an adverse critic; faultfinder.
        4.
(in the ancient Roman republic) either of two officials who kept the register or census of the citizens, awarded public contracts, and supervised manners and morals.
        5.
(in early Freudian dream theory) the force that represses ideas, impulses, and feelings, and prevents them from entering consciousness in their original, undisguised forms.

There. So, as anybody with basic reading comprehension can see, Jack is being slightly dishonest. Again. For approximately the ninety billionth time.

It doesn’t matter one tiny little bit whether or not the subject matter is legal, suppressing it is censorship. So says the English language. “It’s only censorship if the subject matter is legal” is just some make-believe shit Jack came up with because defending bad laws and the abuses of authority gives him a stiffy in his pants.

“The pirates tactics of taking things to their logical extreme and comparing them with anything that is even remotely similar is pathetic. ”

Your tactic of lying right through your teeth repeatedly, building strawman arguments, ignoring points, ignoring facts, ignoring logic, ignoring reason, ignoring the actual meaning of words and inventing your own whenever the actual meaning doesn’t suit your politics, and ignoring what other people say is far, far, FAR worse than pathetic. Pathetic would be an improvement for you. A considerable one.

“By your logic, we could also say that anyone who favors gun registration supports gun bans.”

Haha. The logic is that acts of censorship are, infact, acts of censorship. So your anology makes no fucking sense. Yeah, I know. What a surprise that is.

        “Using pirate logic”

That isn’t pirate logic. It’s a patented Jack Murdock Strawman Argument(TM). What you do is make up some flawed reasoning, attribute it to your opponent, then attack your opponent for “having” such flawed reasoning.

Yes, “any laws that forbid any sort of behavior are evidence of the government’s wish to enslave you” is indeed some of the worst logic ever. But you’re the one who made that logic up.

BTW… According to the second definition of ‘censor’, you’re actually a would-be censor yourself, Jack. Why am I not shocked?

Well sister site torrents.ru was shut down and went back up and running as rutracker.org. In fact, wasn’t pornolab once merged with torrents.ru? Why don’t they either merge them back together or move operation back to russia? Or if necessary put some kind of age warning on the site? I hope this isn’t the end of pornolab. It was the best tracker. I’d rather rutracker.org go down than pornolab.

Yes it is censorship and protecting the children is always the lowest excuse.

In fact I would be impressed if some young kid went through all the steps to do such a BT download along with codec install. Welcomed to his/her prize. Then we hope some adult advise to put this in the right context.

Let us hope they had a back-up server. I would recommend Spain but their laws are changing.

You know what I find funny, that credit card fraud and botnets come from Russia, yet those are more protected than bittorrent sites. This shows which is probably more related to organized crime. It also is another debunk of the MAFIAAs idea that filesharing is related to organized crime.

It just boggles my mind that things like copyright enforcement take precedence over what I feel are more important issues

Also why is it that if porn is an issue in the ukraine, that there are some cam girls that operate out of the ukraine. See such sites as livejasmin.com and myfreecams.com. Although most aren’t from the ukraine, a small handful are. Wouldn’t it be better to find these “peformers” then shut down a bittorrent site that might “infringe” on another countries laws. But wait, I’m sure it comes down to income, cam girls bring in money, bit torrent sites do not.I have reason to believe cam studios probably are run by organized crime as well.

    Just my 2 cents

Maybe the Russian mafia doesn’t want competition when selling their DVD copies on the streets/markets and the MAFIAA didn’t want free porn on the internet either.

So if they both paid the police, they had enough money to do something.

(BTW: never heard of the site until today so i guess children are relatively safe and do not accidentally land there.)

I am not into porn so I don’t really care but I find those check pages a joke. If I was 16 right now and I wanted to see porn and a page popped up and asked me if I was 18 of course the answer is yes. How in the hell could a torrent site guarantee all models are over 18? How could they watch everything and verify it. However they should at a minimum have some disclaimers and a take down policy for underage torrents that are reported.

Anyway in the torrent world anytime the biggest goes away it opens the field for several new entrants. Several will take its place I am sure.

People seem to be confused about what really happened.

It’s not about any kind of age restrictions. Lemme explain.

Though PornoLab is considered a Russian website, its servers were located in Ukraine and by our (I’m Ukrainian) retarded laws production or distribution of ANY KIND of pornographic content is illegal.

Yes, we hardly have any copyright laws however making and/or distributing porn actually considered illegal here. This fucking ridiculous law passed a few years back and makes me facepalm ever since.

Chapter XII Article 301 of the Criminal Code of Ukraine:
    http://www.crime.org.ua/osobliva/12/

    Partial Google translation of it:

“Article 301. Import, production, sale and distribution of pornography:

    1. Importation into Ukraine of works, images or other items of pornographic nature with the purpose of sale or distribution or manufacturing, transportation or other movement for the same purpose, or sale or distribution and coercion to participate in their creation -

punishable by a fine of fifty to one hundred untaxed minimum incomes, or arrest up to six months, or imprisonment for up to three years, with confiscation of pornographic items and their means of production and distribution.

    2. The same actions committed in respect of film and video production, computer software and pornography to minors and selling or distributing them among the works, images or other items of pornographic -

punishable by a fine of one hundred to three hundred untaxed minimum incomes, or imprisonment for up to five years, or imprisonment for the same term, with confiscation of pornographic film and video production, means of production and demonstration.
    …”

And here’s a Wikipedia article about porn laws in the world:
    http://en.wikipedia.org/wiki/List_of_pornography_laws_by_region

Considering the fact we are talking about bittorrent, basically anyone who used the site is a distributor of porn and can be prosecuted. But it would take them a while to get hundreds of thousands of people (I’m counting only Ukrainian users).

All this legal bullshit aside here’s some more info:
    - according to site’s admins it was under DDoS attack three days before the seizure;
    - in the meantime temporary site is up at pornolab.so;
    - most likely PornoLab will return to its domain in the near future.

    P.S. my two cents:
Why it is such a big deal? Because PornoLab is not just some porn site or tracker. It is the most comprehensive catalog of adult content I’ve ever seen and a very strictly moderated one. Think of OiNK but for adult material. There was stuff you can’t find anywhere else. As hard as it may be for someone off you to believe it is a great community.

    • Ryzzo

      Thanks for the clarification!!!

    • alex

Well, you are mostly right, but the change made a few years back was just about storing porn in addition to distribution. Porn was illegal even before that change. It might be confusing since it was never enforced on websites until a few years ago when infostore.org was taken down.

      I’m from Ukraine too.

      • n/a

Well, it’s dodgy. I’m no lawyer and may be mistaken but I believe that before it was similar to Russia’s laws now. Something like “don’t ask, don’t tell” with no exact definition of what classifies as pornography.

Since then the law was made more strict however the part about possession only relates if it’s with intent to distribute. There was a debate about how exactly law enforcement will determine the intent. And that in such wording it could be used by those in power to persecute innocent people.

Well, you are mostly right, but the change made a few years back was just about storing porn in addition to distribution. Porn was illegal even before that change. It might be confusing since it was never enforced on websites until a few years ago when infostore.org was taken down.

      I’m from Ukraine too.

  • Lothor The Evil

Are you people aware The Pirate Bay has adult porn in their search results and that there is no age verification there either for downloading it? It’s the same for many other torrent sites and some of you are condemning one site for that? Lame.

    • Whatever

I don’t see many condemnations, maybe a few trolls.

I never see those results on TPB but from what i have heard you need an user account at TPB to access those.

I think Youtube also does not have a restriction except an user account and maybe an “i’m old enough” checkbox.

Newsgroups must be illegal too in Ukraine (no person or media checks there).

So if porn is illegal in Ukraine what do you ukrainians use for masterbation material? Are Ukrainian women that insecure? Isn’t this law on par with prohibition style laws? Dictators use these type of laws to control people they have nothing to do with morals. The more you deny your people the easier they are to control.

The internet makes this control obsolete. Only those who have little computer knowledge remain ignorant while those with a little computer knowledge can easily get around any censorship.

    • alex

We use online porn in other countries obviously. The law doesn’t prohibit us from watching it, so…

    • n/a

Personally I watched porn since I was a teenager and so everyone of my friends did. Probably just like anywhere else in the world. Also shared CDs, then DVDs, and then I got internet so copying gigs of porn became that much easier. With no legal repercussions whatsoever. And I don’t know of anyone who got in trouble for that.*

It’s like with let’s say weed. You could easily get it despite it being illegal. And probably won’t get caught just because you’re too small of a target. You have to really piss some policeman or I don’t know… some government official so that they would come after you. Or if you’re making money out of it.

But if I can understand why drugs are banned in most countries, banning porn is flat out retarded. It’s exactly like you’ve said — prohibition style laws. But even then, if banning alcohol or tobacco with health reasoning just barely makes any sense, but let’s imagine for a second it does, banning porn is just that much more stupid.

And what makes this law even more laughable, is that I can go out and drink myself to death, or even worse, be an alcoholic and abuse my wife/kids. And it would be fine for me to continue drinking, but I can’t just buy an adult movie.

      * The only big case I heard of was about Ukrainian porn actress by the stage name Wiska. She has a husband and a son and she starred in a lot of hardcore movies by European and American studios. Since she gave an interview to a some big newspaper (I believe in 2007) about her life and work some members of parliament were basically hunting her. Because those grandpas thought it was immoral and got angry she was so open about it. I don’t know all the details or if this shit ended but there was some fuss about it in the news. She left her city and was hiding, something like that.

So to summarize — the numbers in the article say for themselves. Tens of thousands of visitors everyday just from Ukraine alone. So I don’t think they can do much about it. We just have to wait for law-makers to come to their senses an this idiotic law to be overturned.

  • Ah-ha-ha-ha

what will we all do for fapping material now?

back to the naughty woodcuts I guess.

  • Theme

Well, they appear to be back, see homepage http://pornolab.net/

“Dear users! We’re sorry about temporary problems related to changing hosts. BRB!”

  • Louigi Verona

While this is not related to copyright, it is related to freedom. Why should pornography be controlled is yet to be shown. All the arguments presented in general (save the children) do not stand up to critical thinking. I don’t see why government should control when and how people should (not) watch porn.

It really pisses me off that these ukrainian people have to spend money on a police forces that raids some internet servers. Yet you walk streets of keiv, you see prostitution, you see pimping, you see gun shootings, and no lets not focus our resources on these pressing issues, let’s focus on some server that don’t nearly affect the ukrainian people as much as other problems. But yet we’ll charge the ukrainian for these services anyway and we make their lives miserable in process. Overthrow the communism in ukraine.

    • My

Don’t use so black colors :) The problem of Ukraine is a swindler government in last 40 years. This is the example as a rich economics can be down with a bad government.

    • alex

Ukraine is not US and people don’t pay taxes there, companies do. Which is the reason why people don’t give a shit about money spend by government. And you can’t see gun shootings, even if you want to. It’s almost impossible to buy a gun in Ukraine. It’s not like we have a few states where guns are legalized.
Prostitution and other things aren’t that important. There are much bigger problems, like corruption for example.

  • My

Child Pornography is prohibited on Pornolab.net, so it’s not truth about it.
The problem is ALL pornography are prohibited in Ukraine from 2009 year, not only distribution and creation are criminal, but keeping (having) it is also criminal.
Any way, Pornolab.net go work again, at a new hosting in Easter Europe.

    • alex

Again, not since 2009, since always. In 2009 the law was extended with possession of pornography and thats it. Pornolab.net was charged with distribution, which was always illegal in Ukraine.
