Dotcom’s Mega: Anti-Piracy Group Moves To Cut Off Site’s Finances

An anti-piracy group with the stated aim of shutting down file-hosting services by strangling their finances has wasted no time in going after Kim Dotcom’s new baby. Robert King of StopFileLockers says that his outfit has started a campaign to have the payment processor accounts of Mega resellers terminated. King, who is affiliated with the adult industry, says that from the start Mega was never intended to be a legitimate service and has “all the fundamental qualities” of an infringing file-locker.

Yesterday was the big day. After a year of turmoil for Kim Dotcom and this associates, Mega was born from the ashes of Megaupload, destroyed by the U.S. government in January 2012 at the behest of the MPAA.

The launch press conference in front of 200+ guests and a worldwide audience of millions was a loud and at times bizarre affair, but a couple of serious messages were underlined time and again. User privacy via encryption is paramount at Mega but that will not be at the expense of rightsholders.

To that end, Mega says it has had a team of lawyers working to ensure that Mega meets its legal obligations in every respect and the claim that it is the most closely scrutinized start up in Internet history seems like a reasonable one. But already the hawks are circling, one in particular.

Robert King is the lead figure behind StopFileLockers (SFL), an anti-piracy group dedicated to bringing file-hosting services to their knees by strangling their finances. Last year King claimed his group had a hand in disrupting the cash flow to hundreds of sites and actually shutting down dozens more. Now he has a very big scalp on his mind.

King, an Australian and adult industry player, says that StopFileLockers have just begun a “campaign to have the payment processing of all Mega resellers terminated.”

“Mega itself does not process payments because nobody would process payments for it. A couple of Mega resellers have PayPal and they are being terminated,” he says.

Speaking with TorrentFreak, King says Mega can’t meet the standards required by PayPal.

“It has been widely reported that Paypal requires certain conditions to be met to become an approved file sharing merchant, on the face of it many of these conditions cannot be met by Mega,” he said.

A look at Mega’s premium account signup page reveals a selection of resellers, all apparently reputable companies. They include domain name registrar Instra, whose founder Tony Lentino is the new Mega CEO, and other domain companies including EuroDNS and Digiweb. If these companies did indeed find their PayPal accounts closed or frozen, it could potentially disrupt their core businesses to the tune of millions of dollars.

King seems unconcerned and despite Mega’s stance that it is a legitimate business that abides by all relevant laws, he justifies his actions by describing Mega as an operation hiding behind a “thinly veiled appearance of a legitimate cloud hosting service.”

“We haven’t and wont go after legitimate services like Dropbox – however from its inception the new Mega was never intended to be a legitimate cloud storage service as it has all the fundamental qualities of an infringing file locker service, the only thing missing at this stage is an affiliate program,” King adds.

Of course, there will be Mega users who upload copyright-infringing material, just as people upload unauthorized content to YouTube every single minute of every day. However, while YouTube is also a file-locker of sorts, in King’s eyes there is no comparison, despite Mega only being online for a couple of days with no time to prove itself.

“At this stage there is no mechanism by which rights holders can gain access to remove files, there appears to be no plans to institute arrangements whereby files can be matched against MD5 or other fingerprinting technology for automated copyright removal and the detection of harmful content, and the site has not shown any wish to comply with the policies of the payment processors with whom it seeks to do business,” King says.

“Given the site lacks many of these safety features, we believe that Mega is no different to various other file locker services which have had various payment services canceled or suspended.”

But of course Mega is very different technically to most other mainstream file-hosting sites. While it does have a very clear policy on the takedown of illicit content, King suggests that only proactive filtering will be enough to qualify Mega for taking payments via PayPal and other processors. However, due to the site’s encryption mechanisms, hash checking and matching simply won’t work.

In the meantime, StopFileLockers say they are watching how Mega is being used.

“We have already detected a significant amount of illegal and copyright infringing material being shared by the new Mega. There are sites already sharing links to hundreds of copyright infringing titles on Mega,” King says.

TorrentFreak asked King for evidence of the apparently illegal and copyright-infringing material but he declined and said that data would be released in due course. (Note: King’s use of the word ‘illegal’ in the past has been used to describe illegal pornography.)

We sent Robert King’s comments to Kim Dotcom and will update this article when we receive them.

      I’m sure kdc would be happy to grant paypal access to the site. All they will.see is encrypted files, no doubt with encrypted names too. You could have all the proactive filters they want, i believe the files to be encrypted by the access app on the users pc so is encrypteded end to end. The system appears to be geared to personal privacy and sharing files with specific people rather than distributing files infringing or otherwise to the wider public as any recipient would need the location of the file AND a valid encryption key.

      What this King and paypal forget is that storing copyrighted files (be they purchased, self ripped or off p2p) on your own HD or in the cloud is neither unlawful or infringing. The files are personal and private. An act of infringement only occurs if those files are made public. A cloud storage service granting access to private files would break data protection laws in most countries, certainly Europe. Even if files are made public (and no search available) providing no links are publicly posted they may still be considered for many legitimate reasons ‘private through obscurity’. Really, identifying a file as infringing is by locating links posted in public places.

      Youtube is a very different beast, but not for the reasons implied. Unlike Mega, Youtube is designed for sharing video. For that reason there is an integrated search engine and uploaded files are public by default so there is an arguable case for preemptive filters.

      On a final note. I was reading a business article that reported many if not all. The partner companies are investors. It was difficult to ascertain exactly how large a holding kdc has bearing in mind asset seizures, the main things he brings to the party is mega branding, charisma/celebrity and talent. The site has had 20 different lawyers including IP specialists crawling all over the site design,presentation and publicity. Many of whom will no doubt be instructed to come down hard on actions resulting from libelous comments. Think back 10 years to napster which was found to be found infringing in a fair hearing. The branding survived. In kdc and mega(+upload) have been found guilty of nothing.

        Well starting a international payment processor is certainly not as easy as starting a filehost. You need to set up offices all over the world. You need to apply for separate business license in each and every country. Each country has their own laws which need to be adhered to. That means you cannot just provide a common interface for all. Restrictions have to enforced based on user’s nationality in accordance with laws. Then you need tie ups with banks of all countries. It certainly is no small task which is why Paypal is still unable to support all countries even to this day.

    Proactive monitoring violates EU law, and the ECJ clearly held in its Sabum v. Netlog decision that a service provider has no obligation to institute such a regime. Nor does such a requirement follow from the DMCA.

        Checksums would also be absolutely terrible for confirming content, because every self-respecting checksum would change its output from the slightest of changes to the data in question.

        In which case you could just dump the file into a .tar, and voila – check bypassed!

        And if that gets caught, just add some text file in there too.

    …because it would be pointless and wouldn’t work. The files are encrypted, so the MD5′s would be completely different. There’s no way to predict the MD5 has of an encrypted file, even if you use the same key it’ll be different every single time. The only thing that would ever happen is a has collision with some legitimate file. The guy’s an idiot.

      I’m afraid that he wants the hash of the file to be calculated before it is encrypted… but that would defy the entire purpose of encryption, because you’ll be able which file the person has if at least one copy of the file is available elsewhere.

    Megaupload had all that, and did more for copywrong industries than what was asked of it. Still they didn´t care and took it down. So why should Kim give a fuck, when you clearly didn´t give a fuck about him.

      The irony of it is that by taking Megaupload down they have just made things so much worse for themselves. It is great that Kim Dotcom is pro-actively fighting the censorship by innovatively using encryption, making content identification impossible. This kind of technology may have taken much longer to be developed if it weren’t for the constant assaults on internet freedom.

    Eh…. Mega is looking less and less ‘worthy’ to me. Mainly because with my first signup using a Comcast e-mail address, I couldn’t get the confirmation e-mail.

    With the second one using a g-mail address, I got the confirmation e-mail…. but then when I tried to log-in (even though I cut and pasted the password both times, for the signup and the later login) it kept on telling me that I had the wrong password!

    Oh well… we will see what happens when I get the support e-mail back from them.

          I think he might be pasting too much. Windows has a habit of deciding by itself how much is highlighted. Picks up a space and/or enter before/after the actual part you want to copy (one needs to manually deselect those parts).

      It’s working now. It seems copy and paste doesn’t work, you have to type the letters and not control C control V in that field.

      You were right, guys.

      Anyway, Firefox is working now, but I had to check FF settings and select Mega.co.nz to delete cookies on exit manually. Then it worked. But Mega.co.nz didn’t asked for any cookies.

      I configured my FF to ask for my permission if I want to accept, delete on exit or block cookies. Mega.co.nz didn’t send me back any request, it was only loading the website forever and stayed that way.

      That’s odd, maybe it didn’t send requests because it opens in HTTPS? Maybe it’s not compatible with Firefox? Anyway, it worked after I manually inserted the domain mega.co.nz in my FF domain list which tells me what sites have cookies blocked, allowed or set to be deleted on exit.

      And the option to restore password is a must, better yet if we can retrieve our data by inserting our email if we don’t know the password or a secret question, something like that.

    I sent this guy an email on his website (http://stopfilelockers.com/contact-and-media-enquiries-2/) stating I’m using MEGA as a dropbox backup and want to replace my dropbox with MEGA alltogether in the future to store my University projects. (which is the truth actually) as I like the 50 gb and the encryption feature. The encryption feature might prove an advantage when trying to prevent a leak in a project I’m working on, but still having the flexibility of cloud storage.

    I also told him to stop doing this (trying to shut down payment processors of another business) as it’s probably illegal or at least should be.

    I really can’t understand how they can legally bring payment processors down based on assumptions. :O I’m really angry about it too.

    My steer on it is as follows:
    All the reputable payment providers should blacklist the entire online porn industry. There is a vipers nest damaging untold lives. Not that I can imagine who would be stupid enough to pay for porn now you understand.
    Lets have a vote of mothers worldwide. File sharing or Porn merchants, who gets hung out to dry?
    It’s past time one of the big Asian economies put up an international online payment system to wipe out paypal et all anyway, immune to Washington and Brussels pressure.

    If the MAFFIA gets wind of what Robert King is going to do with regards to shutting down payment processing for MEGA and I am sure that the MAFFIA will get to here of this. I would expect any action by the MAFFIA to shutdown MEGA will now be placed on hold by them as I am sure that they will not want to waste the time and expense of going after MEGA themselves when they have a new patsie ie Robert King that is going to go after MEGA. If Robert King fails then the failure will not reflect bad on the MAFFIA as they were not involved.

    All this talk of Robert King stating that he has found all this evidence (after one day) on forums and index sites etc. sure looks as though he is talking out of his blow hole. The only way that he would know whats in the files is if he had the decryption keys to unlock the files to see whats in them and the only way that can ever happen is if people make the decryption key public along with the link to the file.

    Rober King can always use the DMCA takedown procedure that MEGA has to get this files off the internet but I doubt that he will do that because it is much easier for him to shout off the rooftop about infringement etc. then to file for these DMCA’s.

    I hope all this back fires and blows up in Robert King’s face as I do not believe that after one day of business that there are 100′s of links to files on MEGA being available on forums and index sites.

      There is no DMCA takedown process for the files on Mega’s servers, because none of them fall under US jurisdiction ergo they don’t have to abide by the US DMCA laws.

      They have cut all ties with the US – no servers, hosts, domains, or any kind or provider based there or even with an address there. Plus the files are encrypted so Mega have no knowledge of their contents and thus cannot determine if a takedown request is valid to honour it. It’s completely up to the complainant to prove that they have a valid claim in having something taken down.

    Robert King is a failed pornographer which he blames on copyright infringement. If you look at the sites he has managed to close down, they are nothing compared to what is still out there people. By doing what he is doing, file sharing will go deeper underground and become even more difficult to monitor. I do wonder if porn sales have risen since he started his hate campaign against file lockers. my guess is they havent and they wont because 99% of porn is plain and simple crap and not worth paying for. Mr King wont be doing this for too much longer as it seems his funds are fast running out and he is struggling to obtain copyright holders permission to act on thier behalf. If you read through the posts on GFY, 90% of the dirty pornographers do not even support him and think he is somewhat joke along with his dirty porn sidekick from Thialand, so his try at making money from shutting down file lockers is not working, he will get the suprise of his life when attorney papers land at his so called office when he picks on the wrong company. Take a look at his site and see the file sharing google ads.     I’m actually surprised King didn’t announce this at the same time MEGA was released to the public. His accusation that the new Mega is just posing as a cloud storage service and hosting copyrighted content is simply misleading. I don’t use DropBox, but I bet if I wanted to, I could find some copyrighted videos there. You just need to know the right way to look for things. That being said, his campaign is called “StopFileLockers”, so something like this fits his MO.

    Is there a way we can get this guy and his little “StopFileLockers” campaign charged with harassment or something?

    How will MEGA respond to these accusations?

        I could if I wanted to! Finally got my account that I made with my main e-mail address working, though it took nearly 24 hours for the confirmation of account e-mail to get to my address. Logged in 4 times to make sure that I wasn’t going to have a problem logging in as well AND saved my password to a passworded file just in case.

        Edit: And my secondary account is working. Hot damned. They must have fixed the issue I referred to in an earlier post.

    1.) Why is Dropbox an OK site, but Mega isn’t? I have yet to be sanctioned for using Dropbox to transfer MP3s over to my phone. As far as I can imagine, Dropbox would have no way to verify if those MP3s were a legit file or if they had been pirated. And knowing the way MAFIAA operates, I’d be surprised they decided to err on the side of caution & not award my account with a strike (after all its guilty till proven innocent, right).

    2.) Does PayPal really need SFL to tell them Mega doesn’t meet PayPal’s own guidelines for acceptable file-sharing sites? Isn’t that something PayPal & Mega should work out together – without a third party with no inside knowledge of either company?

    3.) Maybe I just read too much into this, but it seemed one argument against Mega was there was no way for rights-holders to tell if someone has uploaded infringing content. But at the end, he claims he has evidence Mega is hosting infringing content…. So if there’s no way to tell what’s uploaded – how do they have evidence infringing material is there???

      Mr King finds the links on forums and blogs which lead to the file lockers, whether they download these files to see what is in the linked file is another story, Im guessing they don’t so have no idea what is really in the file. Now what Mr King does, is gain as many links with the name of the infgringing content file/s and sends it to paypal. It is not Mr King shutting down file lockers, it is paypal who investigate it and then decide on the outcome. All Mr King is doing is cutting off filelocker paypal payments. If an alternative payment system is found Mr King will no longer be able to send links to paypal, and if he tries to shut down advertisers there are many more you can use.

      If that happens then paypal will terminate their account. The problem lies with posting links on forums and other sites with the name of the infringing content and linking it to a filelocker. How Mr King knows about infringing files on Mega is just this reason. Users posting download links to the content with the name on forums and other sites.

    Given the nature of their core business model, this move would also cost PayPal quite a bit of revenue. In the past when they refused to process payments to Wikileaks for example, it was largely because of the perceived “sensitive” nature of the information being shared at that time, and pressure from government officials. I emphatically disagree with their decision, and they became yet another spineless pawn caught up in a game of “power plays” made by those with selfish political agendas for making it, but I doubt they would allow their own revenue (see also: greed) to be compromised by a pornographer and his minions.

    As other commenters have stated, both implicitly and explicitly, we sorely need better alternatives for secure online payment processing. If businesses that are operating within all legal boundaries can be threatened by a group of loud-mouthed party-poopers, and then have major publications entertain the notion as anything beyond laughable on the “what’s the likelihood of this actually happening” scale, there’s clearly a major problem with the current “widely-accepted” options.

      Correct ! All the filelockers need to do is change the payment processors they use. I have said this on many forums about using a payment processor like Bitcoin but it seems to fall on deaf ears. All the swearing and hate will do nothing, to stop Mr King but being one step ahead will. It’s either change and stop using paypal or get your payment cut off.

        Lets look at how tube sites stay online both porn and mainstream. Firstly 99% of them do not use paypal. Secondly they comply to take down requests. Now if filelockers go the same route you will not have a problem with payment proccesors or hosts. If you are going to continue using paypal Mr King will continue to take it away. Simple answer is NOT to use paypal and comply to DMCA requests. If tubes can do it so can file lockers, Its not rocket science !
